An ordinance rel�ting to an amendment of the Grant County Zoning
Map, changing the zoning of approximately 92.36� acres from Agricultural to Rural
Residential l(RRl). The subject �rea is located approximately 1.5 miles east of the
Town of Soap Lalce, south of Hwy 28 �nd north of Road 20 NE and in a portion of
Section 22, Township 22N, R�nge 27E, WM, Grant County, WA.

Recitals:
WHEREA.S, in compliance with the Growth Management Act of 1990, Gr�nt
County adopted a Comprehensive Plan in September of 1999, and
WHEREAS, Grant County adopted the Unified Developinent Code (UDC) in
October of 2000, establishing official zoning districts in conformance with the Comprehensive
Plan, and
WHEIt�AS, tl�e Uniried Development Code Chapter 25.12 "Legislative Actions"
§ 030 establishes a process for malcing Amendments to the Comprehensive Plan, and
WHEItEAS, the Uniried Developinent Code Chapter 23.04 "Zoning Districts" §
150 establishes a process for Minor Zoiung Amendments (Minor Rezones) which are consistent
with the goals and policies of the Colnprehensive Plan, and
V6�H�REAS, 011 DecemUer 19, 2006, Resolution 06-269-CC "A Resolution
Relating to Coinprehensive Planning iz1 Grant Coullty in Accordance with the Washington State
Growth Management Act (RCW 36,70 A) and amending the September, 1999 Comprehellsive
Plan and Development Regulations" was signed Uy the Grant County Board of Coinmissioners,

WHEI2EAS, on December 19, 2006, Ordinance No. 06-269-CC was adopted by
the Grant Couilty Board oF Convnissioners, which, in part, estaUlished the Comprehensive Plan
designation for the subject properties as "Rural Residential 1," and
�VHEI2EAS, an application (#08-5198) for a Miilor Zone Chailge has been
processed in accordance with the UDC Chapter 23.04 "Zolling Districts", Ch�pter 24.04�
"SEPA", and Chapter 25,04 "Perinit Application Review Procedures," aild

WII�I2EAS, the Gra17t County Plamiiiig Cominission held an Open Record
Public Hearing regarding this proposed Minor Zone Change, during their regular meeting on
DecemUer 3, 2008, aFter which they voted Lulanimously to reconullend approval of this Minor
Zoi1e Change, and
WHEREAS, the Grant County Board of Cominissioners held a Closed Record
Public Hearing regarding this proposed zone change on January 6, 2009, and
WI3EREAS, after consideration of the Planning Cominission's report and st�ff
conul�ents, the Board of County Conunissioners voted to approve this Minor Zone Change, and
WHEI2EAS, the Grant County Board of Commissioners have established the
following ten "Findings of Fact" supporting their approval of this Minor Zone Change:
1) T1�e proposed rezone will not be contrary to the intent or purposes and regulations of the
Grant County Code or the Comprehensive Plan;
2) The property in question is suitaUle for uses allowed under the proposed zoning district;
3) Uses allowed under the proposed zone change are compatible with neighboring land uses;
4) The proposed rezone eau be served by adequate Facilities including access, rire protection,
water, storm-water coiltrol, and sewage disposal facilities;
5) Substantial chailges do exist to warrant an amendinent to the cui•rent zoning district;
6) A public need does exist for the proposed rezone. Public need shall lne�n that a valid public
purpose, for which the coinprehensive plan and this chapter have been adopted, is served by
the proposed rezone;
7) Tl1e proposed rezone will not result i11 signil"icant adverse impacts on the huinan or natural
enviroiunents that cannot be initigated by coilditions of approval;
8) The cunlulative impact of additio11a1 requests for like actions (the total of the rezones over
time or space) will not produce significant adverse effects to the enviroru�lent that cannot be
mitigated Uy conditions of approval;
9) The pedestrian aild vehicular trafric associated with the rezone will not be haz�rdous to
existiilg �i1d anticipated traFfic in the neighborhood; and
10) The proposed zoning district does not include any allowable use or activity that would result
in the location of �n incompatible use adjacent to an airport or airfield (RCW 36.70).

I�tOW, THEREFOItE, I3E IT ORDAIN�D, that the Grant County Board of
County Conunissioners hereby rescind the current zoning designation of Parcel #20-0031-006
and
BE IT FURTHER ORDAINED, that through the adoptioll of this ordinance the
Grant Cotulty Board olCominissioners approve the ininor zone change for Parcel #20-0031-006
from Agriculture to Rural Residential 1(RRl), and
SE IT FURTFIER ORDAINED, that the effective date ol this ordinai�ce shall be
5:00 pin of the d�te signed.
