HomeMy WebLinkAboutResolution 08-090-CCBOARD OF COUl�T�' COMMISSIONERS GRAI�TT COUNTY, WASHINGTON RESOLUTION: � IN THE MATTER OF APPROVING A � PRELIMINARY PLAT OF � 84.95 ACRES � INTO SEVENTEEN (17) SINGLE FAMILY � RESIDENTIAL LOTS � FOR JOEL ROS W-AL-L; LOCA-T-ED- ----� -- INAPORTIONOFS28,T21N,R24E, � WM, GRANT COUNTY, WA � RESOLUTION No. 2008- �� �CC APPROVING A PRELIMINARY PLAT OF - WHISPERFN�PLAINS - -- - - ESTATES WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on September 3, 2008, on the matter of a preliminary plat of � 84.95-acres into seventeen (17) residential lots and two (2) open space lots located in a portion of Section 28, Township 21 North, Range 24 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission did approve a motion to recommend to the Board of County Commissioners to approve the proposed preliminary plat with five (5) conditions of approval and eleven (11) findings of fact affirming the recommendation; and, W�IEItEAS, the Grant County Board of Commissioners held a closed record public hearing on October 14, 2008; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does meet the applicable requirements of Grant County Unified Development Code Chapter 22.04 "Subdivisions and Plats"; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does serve the public use and interest; and, IN THE MATTER OF APPROVING A WHISPERING PRELIMINARY PLAT OF � 84.95 ACRES PLAINS ESTATES 1NT0 SEVENTEEN (17) LOTS WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have found that the "Best Available Science" has been considered in the final decision regarding the proposed subdivision; and, WHEIdEAS, the Board of County Commissioners have �ound that the proposed subdivision does comply with the requirements of the U.S. Department of Interior, Bureau of Reclamation and the Quincy-Columbia Basin Irrigation District; and, WHEREAS, the Board of County Commissioners have found that all road improvement requirements are ensured pursuant to GCC § 22.04.450; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does appropriately identify and protect critical areas pursuant to GCC § 24.08; and, WHEREAS, the Board of County Commissioners have made a decision to approve "Whispering Plains Estates Preliminary Plat". NOW, THEREFORE, BE IT RESOLVED THAT, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of � 84.95-acres into seventeen (17) residential and two (2) open space lots; located in a portion of Section 28, Township 21 North, Range 24 East, Willamette Meridian, Grant County, Washington. Parcel #31- 2779-000. CONDITIONS OF APPROVAL: 1) Development shall comply with all requirements of the Grant County Health District, including but not limited to: 1N THE MATTER OF APPROVING A WHISPERING PRELIMINARY PLAT OF � 84.95 ACRES PLAINS ESTATES 1NT0 SEVENTEEN (17) LOTS a) A site registration shall be completed for each lot to determine the suitability for septic system installation. A site registration report must be completed and submitted to the Health District with all fees paid before final approval of the plat will be given. b) The note #2B on sheet 3 of 3 shall be modified to the following: "All new wells are subject to a 100' minimum radius wellhead protection zone. One hundred (100) feet radius shall be maintained from the boundaries of the plat". Additionally, a restrictive covenant shall be recorded with the GC Auditor and referenced on the plat stating that anyone owning a lot in this development is obligated to agree and comply with the 100' minimum radius wellhead protection zone. --- - - - -- - - c) Final plat shall show the recommended locations for the proposed wells with the 100' minimum radius wellhead protection zones around each well. 2) Development shall comply with all requirements of the Grant County Emergency Services including, but not limited to: a) Roads must be designated to the county grid system. 3) Davelopment shall comply with all requirements of the Grant County Public Worlcs, including but not limited to: a) Provide a plat checic fee of $200.00 for Major Plats. b) Scale should be a minimum of 1"-100'. c) Provide control monuments for all road intersections and centerline tangents. d) Provide a plat certificate from the title company for all land being dedicated to Grant County. e) Provide a complete road plan and profile with all centerline data and drainage facilities for new roads. f� An approach permit shall be obtained prior to a building permit. g) Label all right-of-way dimensions or make notation. h) Prior to Public Works signing the final plat all required road construction and improvements shall be completed and accepted by Public Works, or a bond shall be in place �or the required work. i) County Road 13-NW shall be upgraded to county road standard Bituminous Surface Treatment (BST) (4" crashed surfacing base course, 2" crashed surfacing top course, 2 shots of oi126' wide) up to Road 0.7-NW. All interior plat roads that will be public will need to be at county road standard BST as well. 13-NW is on the oil to gravel projects for 2009, in the event that 13-NW is not done prior to the development of the plat the upgrade shall be the proponent's responsibility. j) The reserved easement extended south from O.5-NW shall have an Auditor File Number shown on the face of the plat and that portion shall be built to County Road Standard to provide the secondary access to the plat. k) A hatched `no access' area shall be on the proposed Lot #17: 100' in both directions from southeast corner, Lot #7: 100' east from the northwest corner and lot #6: 100' west from the northeast corner. IN THE MATTER OF APPROVING A WHISPERING PRELIMINARY PLAT OF � 84.95 ACRES PLAINS ESTATES 1NT0 SEVENTEEN (17) LOTS 4) Development shall comply with all requirements of the February 25, 2008 Habitat Management Plan including, but not limited to: a) The following conservation measures shall be incorporated into homeowner's association covenants and submitted for final pre-review (covenants shall be recorded with the GC Auditor and referenced on the face of the plat): i. The developer shall initially marlc the habitat corridor boundaries during the installation of the access roads and infrastructure. The owner(s) of the open space lots must be responsible for maintaining the location of the of the habitat corridor (i.e. pin flags, wooden stakes, etc.) ii. Domestic animals, such as dogs, shall be lcept from running loose within the habitat corridor. iii. Outdoor garbage receptacles must be tightly covered to reduce the chances of attracting nuisance animals and sage grouse, pygmy rabbit, and WA ground squirrel predators to the development. iv. No motorized vehicles shall be permitted within the habitat corridor. 5) Development shall comply with all requirements of the Grant County Department of Community Development/Planning Division, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non-Significance issued by Grant County on March 11, 2008. c) Comply with all requirements listed in UDC Chapter 22.04.260 Time Limitations: "A preliminary subdivision must be recorded within five (5) years from the date of the resolution." d) On the final plat maps: i. 4.15-acre tract, designated as open space, needs to be identified as parcel with the assignad number [UDC 22.04.230(b)(9)]. ii. The notation identified as "General Note" that is provided on sheet 1 of 3 and sheet titled as "Corridor" is not applicable and shall be removed. "BOCC FINDINGS OF FACT" The Board of County Commissioners may want to consider the following criteria in mal�ing their decision. The following criteria may also be used as findangs of fact: (1) The proposed subdivision does / does not meet the applicable requirements of UDC Chapter 22.04 "Subdivisions and Plats"; (2) The proposed subdivision does / does not serve the public use and interest; (3) The proposed subdivision does / does not comply with the Comprehensive Plan, the Shoreline Master Program, the zoning code and other land use regulations, and SEPA; (4) The proposed subdivision does / does not comply with health requirements for sewage disposal and potable water supply; (5) The proposed subdivision does / does not contain an accurate legal description of the lots being created, and the roads and easements therein; 1N THE MATT�R OF APPROVING A PRELIMINARY PLAT OF � 84.95 ACRES INTO SEVENTEEN (17) LOTS WHISPERING PLAINS ESTATES (6) The proposed subdivision does / does not comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; (7) The best available science has / has not been considered in the final decision regarding the preliminary plat. (8) The proposed subdivision does / does not comply with requirements of the U.S. Department of Interior, Bureau of Reclamation and the Moses Lalce Irrigation and Rehabilitation District. (9) All road improvement requirements are / are not ensured pursuant to GCC § 22.04.450. (10) The proposed subdivision does / does not appropriately identify and protect __ __ __critical_areas pursuant to_GCC_§24.08.___ _ ____ _ _ __ _ _ _ ____ _ _ (11) The disturbance footprint of the residential lots in this development has / has not been limited to the least amount possible to maintain as much of'the existing shrub-steppe vegetation and/or undeveloped land as possible.
