HomeMy WebLinkAboutResolution 08-050-CCBQARD UF �OUNTY COMM�SSIONERS Grant County, Washingion IN T]EIE 1'VIA'TTER O� Al'PIt�IVING A PRELIMINARY PLAT UF 160.77 ACRES INTO FIVE (5) LOTS FOR KENNETH & DAINA TOEVS, LOCATED IN THE SW 1/a OF SECTION 15, TOWNSI�IP 20 NORTH, RANGE 23 EAST, WM, GR.A,NT COUNTY, WASHINGTON 12�SOI,IJTION NOa OS- �� -�C APPROVING A PRELIMINARY PLAT OF T& T FARMS LONG PLAT WHEREAS, the Board oi Count� Commissioners of Crrant County have been advised that an open record public hearing was conducted before the Grant County Planning Commission on June 4, 2008 in the matter of a Pr�liminary Plat of 160.77 acres into �ve (5) lots, which are located in a portion of Section 15, Towr�ship 20 North, Range 23 East, Willamette Meridian, Grant County, Washington, and WI�EREA�, the �rant County Planning Commission on June 4, 2008 did approve a motion to recommend to the Board of County Commissioners to deny this proposed Preliminary Plat with Fact Nurnber Two (#2) of the ten (10) Findings of Fact found to be in the negative, and WHEREAS, the Board of County Commissioners held a closed record public hearing regarding this matter on July 8, 2008, and W�REAS, the Board of County Commissioners have reviewed the applicatiion material, staff report, and a summ.ary of iha Planning Commission hearing, and WAEREAS, the Board of County Commissioners have found that this proposal will not adversely effect the health, safety, and general w�lfare of the public in the vicinity of the proposal, and WHEREAS, the Board of County Commissioners have found this proposal to be consistent with the Grant County Comprehensive Plan, the Unified Development Code Chapter 23.04 "Zoning," other land use regulations, and SEPA, and WHER�AS, the Board of County Commissioners have found that the public use and interest will apparently be served by the proposed Preliminary Plat, and WHEREAS, the proposed Preliminary Flat, subject to the Conditions of Approval, rneets the applicable requirements of the Unified Development Code Chapter 22.04 "Land Division," and WHEI2EAS, the proposed Preliminary Plat does comply with the Health District's requirements for sewage disposal and potable water supply, and VVHEREAS, the proposed Preliminary Plat does contain an accurate legal description of the lots being created, and the roads and easements therein, and IN TH� MATT�R OF Al'PROVING A PRELIMINARY T& T FARMS LONG pLAT PLAT OF 160.77 ACRES INTO FIV� (5) LOTS I+OR iCENNETFI & DAINA'Y'OEVS WHEREAS, the proposed Preliminary Plat does comply with Grant County regulations pertainin� to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements, and WT�REAS, the Baard of County Commissioners have found that "best available science" has been considered in the final decision regarding the proposed subdivision, and WHEREAS, the Board of County Commissioners have found that all road improvement requirements are ensured pursuant to Grant County Code § 22.04.450, and WHEREAS, the Board of County Commissioners have %und that the proposed subdivision does appropriately identify and protect critical areas pursuant to Grant County Code § 24.08, and �VHER�AS, the Board of County Commissioners have made a decision to approve the T& T Farms Long Plat, NOW, THEREFOI2E, BE IT RESOLVED THAT the Board of County Cammissioners nf Grant County, Washington hereb� approve by this Resolution, subject to the fourteen (14) Conditions of Approval listed below, a Preliminary Plat of 160.77 acres into fve (S) lots, located in a portion of Section 15, Township 20 North, Range 23 East, Willamette Meridian, Grant County, Washington (Paxcels #15-0622-000, #20-1032-000, & #20-1035-OOQ). CONDITIONS OF APPROVAL 1) Develapment shall be in compliance with the Crrowth Management Act, the countywide Planning Policies, the Washington State Environmental Policy Act, the Grant County Comprehensiv� Plan, the Grant Cottnty Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Development shall comply with all requirements of th� Grant County Fire Marshal and shall be in compliance with Grant County Fire Flow guidelines, the Uni�orm Building Code, the Uniform Fire Code, and all ather applicable requirements for fire protection and safety. 3) This proposal shall comply with all requirements deemed necessary by tl�e Washington State Department of Health and the Washington State Department of Ecology in regards to domestic watier supply, sewage systems, and storm water control and treatment including, but not limited to: RCW 90.48.080 (Discharge of Polluting Matter in Waters Proh�bited), WAC 173-200 (Ground Water Quality Standards), WAC 173-201-A (Sl�rface Water Quality Standards), and WAC 246-272 (On-Site Sewage Systems). 4) If any Native American grave site(s) or archaeological/cultural resources (Indian artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the Grant Count� Planning Department, Colville Confederated Tribes, and the Washington State Of�'ice of Archaeology and Historic Preservation. 5) This proposal sha11 comply with any/all applicable Federal, state, and local regulations in place at the time the applications were deemed Technically Camplete; that date being April 1 l, 20Q8 in this instance. Kenneth & Daina Toevs Prelirninary Plat - BoCC Resolution - page 2 � IN'X'HE MATTER OF APPROVING A PRELIMINARY T& T FARMS LONG PLAT PLAT OI' 160.77 ACRES INTO FIVE (5) LOTS FOR KENN�TH & DAINA 'I'OEVS 6) ]�uring any construction activities, county roads shall be maintained clear of soil and rocics at point(s) of ingress and egress. 7) The applicant shall comply with all requirements as deemed necessary by the Grant County Fire Marshal/Building Official, including, but not limited to: a) All real development and infirastructure supporting real development must comply with all applicable codes. 8) The applicant shall comply with all requirements as deemed necessary by the Grant County Public Worlcs Department, including, but not �imited to: a) Provide a plat check fee of $200.00 for Major Plats. b) Scale should be a rninimum of 1" = 100 ft. G) Provide a plat certificate from the title company for all land being dedicated to Crrant County. d) An Approach Permit shall be obtained prior to a building permit. 9) The applicant shall comply with all requixements as deemed necess�ry by the Grant County Assessor, including, but not limited to: a) Client must contact Assessors Office regarding status of current use continuance at least one weel{ before recording plat. 10) The applicant shall comply with all requirements as deemed necessary by Grant County Emergency Services, but not limited to: a) Add.ress must be posted for each lot that contains a residence. 11) The applicant shall comply with all requirements as deemed necessary by the Grant County Auditor, including, but not limited to: a) The name "T & T Farms Long Plat" is approved. 12) The applicant shall comply with all requirements as deemed necessary by the U.S. Bureau of Reclamation, including, but not limited to: a) All survey data on Bureau of Reclamation Farm Unit Maps pertaining to Reclamation facilities, associated rights-of-way, and farm unit boundaries within the area being subdivided must be included on the plat. b) Landowners should be aware of existing Reclamation and District rights to construct, reconstruct, operate, and rnaintain Project facilities as necessary. Any worlc that will involve these facilities or the existing rights-of-way must be reviewed and approved by Reclamation and the District prior to proceeding. c) Structures are prohibited from encroaching upon existing right-of-way corridors without Reclamation's and the Di�trict's prior approval. This includes, buti is not limited to, temporary improveinents such as paving, fencing, and landscaping. d) Reclamation's concurrence to this proposal is conditioned upon the assumption that there are no encroachments upon Project facilities or rights-of-way. e) Lots l, 2, 3, and 4 of the proposed shor� plat consist of less than 10 acres par lot and will be separate and individual sites. The Bureau of Reclamation recommends that the agricultural water supply be released from those portions of land. The proponent can initiata this process by contacting the District Headquarters in Quincq, WA. � The proposed plat is located within the Quincy Ground Water Subarea (QGWSA). Should the proponents desire to use ground water for other than domestic purposes Kenneth & Daina Toevs Preliminary Plat - BoCC Resolution - page � IN TI-TE MATT�R OF APPROVING A PRELIMINARY PLAT OF 160.77 ACRES INTO FIVE (5) LOTS FOR KENN�TH & DAINA TO�VS T& T I+ARMS LONG PLAT (5,000 gals. pex day/irrigation of �/2 acre per dwelling, as established in WAC 173- 134A), they will be raquired to obtain both a Cnound Water Permit from the WA State Department of Ecology and a QGWSA license from the Bureau of Reclamation. 13) The applicant shall comply with all requirements as deemed necessary by the Quincy- Calumbia Basin Irrigation District, �ncluding, but not limited to: a) Quincy-Columbia Basin Irrigation District Short Plat Fee of $50 for the first split (first two lots), plus $10 each additional lot. b) A useable irrigation right-of-way from the l�gal point of water delivery to each segregation within the Farm Unit is to be dxawn on the face of the p1at. If access to the turnout cannot be obtained, the water must be released befor� the plat is signed. 14) The applicant shall comply with all requirements as deem�d necassary by the Grant County Planning Department, including, but not limited to: a) Development shall comply with the requirements of GCC § 22.04 Article V"Final Subdivisions and Short Subdivisions" and all othex pertinent portions of Grant County Code. b) Development shall cornply with all requirements included in the S�PA Mitigated Determinatian of Nan-Significance issued on May 7, 2008. c) The applicant sha11 not put individual werls on the lots proposed by this project. Instead, individual new lot owners wi11 be expected to put in their own wells. d) On Sheet 1 of 2, please remove or amend the Comrnon Access Point and Access Note in ord�r to comply with requirements of the Grant County Public Worlcs Department.
