ORDINANCE No. 08- o,��.-CC
An ordinance relatin� to amendment of the Grant County Zoning
Map changing approximately 2.47 acres owned by Leo Jack Morad,
in a portion of Sectian 17, Twp. 19 N. Rng. 28 E WM., from Urban
Residential3 to Urban Residential 2
Recitals:
WHEREAS, in compliance with the Grawth Management Act of 1990, Grant County
adopted a Comprehensive Plan in September of 1999; and
WHER.EAS, Grant County adopted the Unified Development Code (UDC) in October of
2000, establishing aff'icial zoning districts in eonformance with the Comprehensive P�an;
and,
WHEREAS, the Uni�ed Development Code Chapter 25.12 "Legislative Actions" § 040
establishes a process for making Amendments to the Comprehensive Plan; and,
WHEREAS, the Unified Development Code Chapter 23.04 "Zoning Districts" § 150
establishes a process for Minor Zoning Amendments which are consistent with the goals
�nd policies of the Comprehensive Plan; and,
WHEREAS, Resolution No. 06-269-CC "A Resolution Relating to Comprehensive
Planning in Grant County in Accordance with the Washin,gton State Growth Management
Act {RCW 36.70.A) and Amending the September, 1999 Comprehensive Plan", was
signed by the Grant County Board of Commissioners; and,
WHEREAS, Resalution No, 04-036�-CC included approval of Amendment #2002-20
submitted by Crrant County Planning staff, changing the Comprehensive Plan Land Use
designation Urban Residentia7 3 to Urban Residential2 and,
WH�REAS, an application (#08-5010) for a Minor Zone Change has bee� processed in
accordance with the UDC Chapter 23,04 "Zoning Districts", Chapter 24.04 "SEPA", and
Chapter 25.04 "Permit Applicatian l�eview Procedures"; and,
WHEREAS, the Grant County Planning Commission held an Open Record Public
Hearing regarding this proposed zone change, during their regular meeting on Apri12,
2008, after which they vated unanimously to recommend approval of this minor zone
change; and,
WHEREAS, the Grant Caunty Board of Commissioners held a Closed Record Public
Hearing regarding this proposed zone change and,
WHEREAS, after consideration of the Planning Commissions report, and staff
comments, the Baard of County Commissioners voted to approve this zone change; and,
WHEREAS, the Grant County Board of Commissioners have adopted the following t�n
"Findings ofFact" established by the Planning Commission in support oftheir
recommendation for approval of this zone change:
1. The change (wauld) benefit the public health, safety, and or welfare;
2, The change (is) warranted because o�changed cireumst�nces or because of a
need for additional property in the proposed land use designation.
3. The change (is) consistent with the criteria for land use designations specified
in the Comprehensive Plan.
4. The change (will hot) be detrim�ntal to uses or property in the immediate
vicinity of the subject property.
5. The change (does have) merit for the community as a whole.
6. The change, if granted, (will not) result in a group of property owners
enjoying greater privileges and opportunities than those enjoyed by other
prnperty owners in the vicinity where there �s not substantive difference in the
properties themselves which justify different designations.
7. The bene%ts of the change (will) outweigh any significant adverse impacts af
the change.
8. The change (is) consistent with the purpase and intent of the Comprehensive
Plan and the requirements of GCC 22, 23, 24 and 25.
9. The change (�'oes) camply wi�h all other applicable criteria and standards of
Chapter 25.12 UDC.
NOW, THEREFQRE, BE IT ORI)AIN'ED, that the Board of County Commissioners
hereby rescinds the current zoning designation on the Off�icial Zoning Map of parcel #'s
12-1090-021.
BE IT FURTHER ORDAINED, thati through the adoption of this ordinance the Grant
County Board of Cammissioners approves this zane ch�nge from Urban Residential3 to
Urban Residential2 and;
BE IT FURTHER ORDAINED, that the effective date af this ordinance shall be S p.m.
of the date signed.
