An ordinance relating ta amendment o� the Grant County Zoning
Map changi«g approgimately 163 acres owned by AVILLA L�ND
L.L.C., in a portaon of Seetion 3G, Twp. 20 N. Ran�c. 2$ E WM., from
Agriculture to Rural Residential 1
Recitals:
WHEREAS, in compliance with the GrowCh Nlanagement Act of 1990, Grant �ounty
adopted a Comprehensive Plan in September of 1999; and
WHEREAS, Grant County adopted the Unified Development Code (UDC) in October of
2000, establishing off'icial zoning dis�ricts in conformance with the Gomprehensive Plan;
and,
WHEREAS, the Unified Development Code Chapter 25.12 "Legislative Actions" § 040
establishes a process %r making Amendments to the Camprehensive Plan; and,
�'HEREAS, the Unified Development Cade Chapter 23.04 "Zonin� Districts" § 150
establishes a process for Minor Zonin� Amendments which are consistent with the goals
and policies of the Compreh�nsive Plan; and,
WHEREAS, Resolution No. 06-269-CC "A Resolution Relating to Comprehensive
Planning in Grant County in Accordance with the Washingtan State Growrh Management
Act (RCW 36.70.A) and Amending the September, 1999 Comprehensive Plan", was
s�gned by the Grant County Board of Commissioners; and,
WHEREAS, Resolution Na. 08-005-CC included approval of Amendment #07- 4913
submitted by Avxla Land LLC, changin�g the �amprehensive Plan Zand Use desi�nation
from Agriculture to Rural Residential 1 and,
WHEREAS, an ap�lication (#OS-5033) far a Minor Zane �hange has been processed in
accordance with the UDC Chapter 23.04 "Zoning Distriats", Chapter 24.04 "SEPA", and
Chapter 25.04 "Permit Application Review Procedures"; and,
WHEREAS, the Grant County Planning Commission held an Open Record Public
Hearing regarding this proposed zone change, during their regular meeting an May 7,
2008, after which they voted unanimously to recommend approval of this minor zone
change; and,
�'HEREAS, the Grant County Board of Commissioners held a Closed Record Public
Hearing regarding this proposed zone change and,
WHEREAS, after consideration of the Planning Commissions report, and staff
comments, the Baard of County Commissioners voted to approve this zone change; and,
WHEREAS, the Grant County l3oard of Commissioners have adopted the following ten
"Findings of Fact" established by the Planning Cammission in support of �heir
recommendation for approval of this zone change:
1, Tk�e change (would) ben�fit the public health, safety, and ar welfare;
2. The cha�ge (is) warran�ed because of changed circumstances or because of a
need for additional praperty in the proposed land use desi�nation,
3. The change (is) consistent with the criteria for land use designations specified
in the Gomprehensive Plan,
4, The change (will not) be detrimental to uses or property in the immediate
vicinity of the subject property.
5. The ch�ange (does have) merit for the community as a whole,
6. The change, i�granted, (will �zot) result in a group of property owner�
enjoying greater privileges and opportunities than those enjoyed by other
property awners in th� vicinity where there is not substantive dif�erence in the
properties themselves which justify different designations.
7. The benefits of the change (will) outweigh any significant adverse impacts of
the change,
8, The change (is) consistent with the puxpase and intent of the Comprehensive
Plan and the requirements of GCC 22, 23, 24 and 25.
9. The change (does) comply �vith all other applicable criteria and standards of
Chapter 25.12 UDC.
1�TC)W, TIIEREFORE, BE IT 4RDAIN�D, that the Baard of Caunty Commissioners
hereby rescinds the current zoning designation on the Official Zoning Map of parcel #
19-0328-000.
�E IT FURTHER ()RDAINED, that through �he adoption di this ordinance the Grant
County Board of Commissioners approves this zane chan�e from Agriculture to Rural
Residential 1 and;
BE IT FURTHER ORDA.LIVED, that the effective date of this ordinance shall be 5 p.m,
of the date signed.
