An ordinance relating to amendment of the Grant Coanty Zoning
Map changing approximately 166 acres ownec� by Clint Brown,
Revocable Living Trast, an a portion nf Section 15, Twp. 201`T. Range.
26 E WM., from Agriculture to Rural Residential 1
Recitals:
WHEREAS, in compliance with the Growth Management Act af 1990, Grant County
adopted a Comprehensive Plan in Septernber of 1999; and
WHEREAS, Grant County adopted the Unified Development Code (UDC) in October of
2000, establishing official zoning districts in conformance with the Comprehensive Plan;
and,
WHEREAS, the Unified Develapment Code Chapter 25.12 "Legislatiive Actions" § 040
establishes a process for making Amendments to the Comprehensive Plan; and,
W�E�AS, the Unified Development Code Chapter 23.04 "Zoning Districts" § 150
establishes a proc�ss for Minor Zoning .Amendments which are consistent with the goals
and pnlicies of the Comprehensive Plan; and,
'V6'HEREAS, Resolution No. 06-269�CC "A Resolution Relating to Compreher�sive
Planning in Grant County in Accordance with the Washington State Growth Management
Act (RCW 36.70.A) and Amending the September, 1999 Comprehensive Plan", was
signed by the C�-ant County Board of Commissioners; and,
WHEREAS, Resolution No. 08-005-CC included approval of Amendmant #07- 4873
subm�tted by Clint Brown, changing the Compxehensive Plan Land Use designation from
Agriculture ta Rural Residential 1 and,
WHEREAS, an applicatior� (#08-5033) %r a Minor Zone Change has been processed in
�ccordance with the T.JDC Chapter 23.04 "Zoning Districts", Chapter 24.04 "SEPA", and
Chapter 25.04 "Permit Applzcation Review Procedures"; and,
WHEREAS, the Grant County Plannin�; Commission held an Open Record Public
Hearing regarding this propased zone change, during their regular me�ting on May 7,
2008, after which they voted unanimously to recommend approval of this minor zone
ch�ange; ar�d,
`Wi�ElIt�AS, the Gra�t County Board of Commissioners held a Clased Record Public
Hearing regarding this propased zone change and,
WHEREAS, after consideration of the Planning Commissions report, and staff
comments, the Board of County Commissioners voted to approve this zone change; and,
WHEREAS, the Grant County Board of Commissioners have adopted the following nine
"Findings of Fact" established by the Planning Commission in support of their
recommendation for approval of this zone change:
1. The change (would) benefit the public health, safety, and or welfare;
2. The change (is) warranted because of changed circumstances or because of a
need for additional property in the proposed land use designation.
3. The change (is) consistent with the criteria for land use designations specified
in the Comprehensive Plan.
4. The change (will not) be detrimental to uses or property in the immediate
vicinity of the subject property.
5. The change (does have) merit for the community as a whole.
6. The change, if granted, (will not) result in a group of property owners
enjoying greater privileges and opportunities than those enjoyed by other
property owners in the vicinity where there is not substantive difference in the
properties themselves which justify different designations.
7. The benefits of the change (will) outweigh any significant adverse impacts of
the change.
8. The change (is) consistent with the purpose and intent of the Comprehensive
Plan and the requirements of GCC 22, 23, 24 and 25.
9. The change (tloes) comply with all other applicable criteria and standards of
Chapter 25.12 UDC.
NOW, T�IEREFOI2E, BE IT ORDAINED, that the Board of County Commissioners
hereby rescinds the current zoning designation on the Official Zoning Map of parcel #
13-0139-045.
BE IT FURTHER ORDAINED, that through the adoption of this ordinance the Grant
County Board of Commissioners approves this zone change from Agriculture to Rural
Residential 1 and;
BE IT FURTHER ORDAINED, that the effective date of this ordinance shall be 5 p.m.
of the date signed.
