The Grant County Commissioners session was called to order at 9:0o am with all the Commissioners in
attendance with the Clerlc of the Board.
CIJOSED RECORD PUBLI C HEARING, PATRICIAL MITCHELL REASONABLE USE
EXCEPTIOleT
The Commissioners held a Closed Record Public Hearing regarding a Reasonable Use Exception
application from Patricia Mitchell to allow the development of a single-family dwelling on a 2.50-acre
parcel in the Rural Residential i zone. The existing parcel does not meet density requirements of the RRi
zone,l dwelling unit per 5 acres. The property is located in the northwest of the intersection of Rd i�.6
and State Route 23; and is in a portion of S 2, T 2i N, R 26 E, W M(Parcel no. i6-o756-000).
Commissioner Allison moved to uphold the Planning Commission recommendation and approve the
application as presented, recognizing the 6 Conditions of Approval and the 6 Findings of Fact.
Commissioner Carter seconded and the motion passed unanimously. The hearing adjourned.

CLOSED RECORD PUBLI C HEARING, CLINT SROWN MINOR ZONE CHANGE
The Commissioners held a Closed Record Public Hearing regarding a minor zone change application from
Clint Brown Revocable Living Trust, to change one parcel totaling approx. 166-acres with a
Comprehensive Plan Land Use Designation of "Rural Residential i. The applicant has submitted an
application requesting a Site Specific Minor Zone Change to Rural Residential 1 to malce it consistent with
the land use designation as approved by the Planning Commission and BOCC during the 200�
Cornprehensive Plan Amendment cycle.

Commissioner Carter moved to uphold the Planning Commission recommendation and approve the
application as presented, recognizing the 9 Findings of Fact. Commissioner Carter Allison and the motion
passed unanimously. The hearing adjourned. (Resolution No. 08-o45-CC)

CLOSED RECORD PUBLIC HEARING SHELLY STEVENS MINOR ZONE CIIANGE
The Commissioners held a Closed Record Public Hearing regarding a minor zone change application from
Shelly Stevens to change a 6o-acre parcel zoned Agricultural with a Comp Plan Land Use Designation of
Rural Residential i. The applicant desires a zone change to Rural Residential i in order to make the
zoning consistent with the land use designation as approved by the Planning Commission and the BOCC
during the 2007 Comprehensive Plan Amendment Cycle. The applicant has also submitted an
Environmental Checklist for review and comment. The parcel is located in a portion of S 22, T 22 N., R 26
E, W M(Parcel nos. i6-1929-000, i6-i929-ooi, and i6-i93o-o00). Commissioner Carter moved to
uphold the Planning Commission recommendation and approve the application as presented, recognizing
the 9 Findings of Fact. Commissioner Allison seconded and the motion passed unanimously. The hearing

OPEN RECORD PUBLIC HEARING, REQUEST TO AI'PROVE THE COLUMBIA BASIN
DISPUTE RESOLUTIO1vT CENTER AND FEE SURCHARGE
The Commissioners held an Open Record Public Hearing regarding a request to approve the
establishment of the Columbia Basin Dispute Resolution Center (CBDRC) and impose a District Court
filing fee surcharge per RCW �.75.

This RCW allows for the maximum of $io.00 on each civil filing fee and a$i5.00 on each small claims
action. This surcharge shall be in addition to any existing surcharges currently in place on civil filing fees
in District Court and small claims actions. Teresa Chen, Deputy Prosecutor for Grant County and the
President of the CBDRC, discussed the purpose of the Center and when it would be used. Ms. Chen stated
that this mediation process is more cost effective for the County than having Court costs. The mediators
must be certified. Grant County is the largest community that does not have a DRC. Chris Ries, Attorney
in Moses Lalee, voiced his concern over the filing fee that this DRC will be financed with. He does not
dispute the existence of the DRC, but believes that District Court does not have the congestion to warrant
this surcharge fee. Marimae Warring stated that the Judges have said there is a lot of congestion in
District Court, and that this Center would assist those who cannot afford an attorney. Roy Warnicic,
Central Bonded Collectors, Moses Lalce, discussed his concern over the filing fee. He believes his business
is also a DRC between the creditor and the debtor. He doesn't see why his business should bear the costs
in filing fees when he wouldn't be using it, believes his costs would increase by 25%. Gloria Ogoshi
Mediator, Disputes Mr. Warnicic's 25% increase in fees. Mediator lceeps the parties involved on the
subject at hand, including debt cases. Family court is a major portion of their business; the clients have to
spealc to each other which is beneficial to the children. She believes that the nominal surcharge is worth it
and noted that DRC's are also funded by the State. Commissioner Stevens asked if Gloria new the
percentage of cases that went to mediation. She did not, but referred Commissioner Stevens to the back
of the CBDRC pacicet for last years statistics. Commissioner Allison asked about the revenue that would be
generated by the surcharge. Gloria Ogoshi stated approx. $4-$6,000.0o per year. Commissioner Carter
asked if a fee will be imposed on the clients. Gloria Ogoshi stated that all clients will pay a charge but on a
sliding scale. Teresa Chen spolce of District Court and how the congestion is so bad that cases are being
dismissed and that she believes the County is losing money due to this. Commissioner Allison moved to
close the public comment portion of this hearing, Commissioner Carter seconded and the motion passed
unanimously. Commissioner Allison stated that he believed there is a need for the DRC and moved to
approve the establishment of the CBDRC; Commissioner Carter seconded this motion but stated she
would like to take more time to discuss the fees and thought that the Board should continue this hearing
and set a hearing for a later date. This motion passed unanimously. Commissioner Allison moved to
continue this hearing to July 8, 2008 at i1:go am to decide if they want to impose a filing fee,
Commissioner Carter seconded and the motion passed unanimously. The hearing adjourned.

The Commissioners approved and signed items i and 2 as listed above and set the bid opening date for
July i5, 2008 at i:3o pm and 1:45 pm.
The Commissioners signed item 3 as listed above.
The Commissioners approved the recommendation from the Director for Public Worlcs to approve two (2)
Requests to Grant County Road Department for reimbursable work from the Royal City Public Works
Department, to asphalt two road sections in the 20o block of Camelia St NE, in the East bound lane and to
asphalt trench at ii2 Wildflower Dr.
The Commissioners approved the recommendation from the Director for Public Works to approve a
Request to Grant County Road Department for reimbursable work from the City of Moses Lalce to add
another BST lift to City owned portion of Rd "L" and Kittleson Rd to the east boundary line of Lot 2
Sparks S/P.

Interlocal Agreement to Create an Interagency Narcotics Enforcement Team (INET) between

As of this date, the Board, by a majority vote, does approve for payment those vouchers certified by the
auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified by the
auditing officer as required by RCW q2.24.090, in the amount of $975�40�.50, as recorded on a listing
and made available to the Board.
The Commissioners signed the Public Works Claims Fund Voucher Approval No. o6-i through No. 06-101 in
the total amount of $��9�579•79� as recorded on a listing and made available to the Board.
