Home My WebLink AboutResolution 13-033-CC'i i BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON RESOLUTION PROHIBITING SMOKING IN CERTAIN OPEN SPACES WITHIN THE ) RESOLUTION NO. 13- � �� -CC GRANT CQUNTY FAIRGROUNDS ) ' ) WHEREAS, pursuant to the provisions of RCW 36.32.120(6), the Board of County ' Commissioners of Grant County has the care of County property and the managemeilt of County ' funds and business; and WHEREAS, pursuant to the provisions of RCW 36.37.010, the holding of county fairs is declared to be in the interest of public good azzd a strictly county purpose; and WHEREAS, pursuant to the provisions of RCW 36.68,090, Grant County is empowered to build, construct, care for, control, supervise, improve and maintain public recreational , facilities and in conjunction therewith may malce, promulgate and enforce such rules and ' regulations regarding the use thereof as may be deemed by the Board of County Commissioner to be reasonable; and WHEREAS, pursuant to the above-cited statutory provisions, Grant County owns and operates the Grant County Fairgrounds, which consists of certain buildings and other open spaces; and WHEREAS, pursuant to the provisions of chapter 70.160 RCW (Washington Clear Indoor Air Act), smolcing, as defined therein, is prohibited in public places; and WHEREAS, smolcing is prohibited in all public places within the Grant County Fairgrounds pursuant to chapter 70.160 RCW. However, such law does not address smoking within open space areas at the Grant County Fairgrounds; and WHEREAS, the Grant County Health District,pursuant to a Policy Memo dated May 29, 2012, has stated that Grant County residents experience five fewer years of healthy life than the average Washington resident, and that smolcing is a coiltributing factor. Further, the Grant County Health District has recommended that a smolce-free fairground would model Grant County's excellence concerniiig its healthy outdoors environment. Further, the Grant County Health District has suggested an option, to wit: enactment of a smoke-free policy for the Grant County Fairgrounds with the exception of designated sinolcing areas; and WHEREAS, pursuant to the observation, recommendation and option presented by the Grant County Health District, the Board of County Commissioners deems it advisable to enact a RESOLUTION PROHIBITING SMOKING IN CERTAIN OPEN SPACES WITHIN THE GRANT COUNTY FAIRGROUNDS Civil 8\Departments\Resolutions\2013u'rohiUit Smolcing G-14-13 , policy prohibiting sinoking in all open spaces within the Grant County Fairgrounds, except in those spaces designated as sinolcing areas, so that, in effect, smolcing will not only be prohibited by RCW 70.160 within all buildings within the Grant County Fairgrounds, but additionally in all open spaces as well, excepted, designated smolcing areas notwithstanding. NOW, THEREFORE, BE IT RESOLVED AND ORDAINED by the Board of County Commissioners of Grant County, does adopt, pursuant to the statutes referenced herein, the policy set forth in Attachment "A", the same fully incorporated by reference herein, which prohibits smolcing in and about open spaces within the Grant County rairgrounds, subject to the exception of those spaces designated as smolcing areas. Such policy shall become effective immediately upon adoption of this Resolution by the Board of County Commissioners. PROVIDED: If any provision contained within this resolution, or its application to any person, party or circumstance is held invalid, the remainder of this resolution or the application of provisions to other persons, parties or circumstances, shall not be affected. POLICY No person may smolce in an open space within the Grant County Fairgrounds except in those spaces specifically designated as sinolcing areas. As used in this policy, the following terms have the meanings indicated: (1) ��Smolce" means the carrying or smoking of any kind of lighted pipe, cigar, cigarette, or any other lighted smolcing equipment. (2) "Open Space" means any area other than an area occupied by the building or vehicle. (3) "Grant County Fairgronnds" means that area located at and commonly lcnown as 3953 Airway Drive NE, Moses Lake, Washington. OPTIONS • Enact a smoke-free policy for the Grant County Fairgrounds with designated smol{ing areas; • Enact a smoke-free policy for the Grant County Fairgrounds; or • Enact a smoke-free policy for all Grant County owned or leased properties. RECOMMENDATION The Grant County Fairgrounds serves as a family friendly venue to promote and celebrate the excellence of Grant County. One showcase example of Grant County's excellence is its healthy outdoor environments. Having a completely smoke free fairground would model this value to residents and visitors to Grant County. A smoke free fairground could also serve as a pilot program for future smoke free public environments in Grant County. There are examples both within Washington State and throughout the country of , smoke free fairgrounds and other public spaces such as parks and trails.
