The Commissioners approved and signed �he Grant County Payroll Authorization form for the November 8, 2013 payroll. C Swartz w/J Johnston, Grant County Economic Development Council GC EDC Discussion (GC EDC Office, Moses Lake) , 9:00 a.m.—10:30 a.m. C Swartz at MACC Meeting(Armory Bldg, Moses Lal<e) 10:30 a.m.—12:00 p.m. Commissioners at MACC DigiCal Radio System Ribbon Cutting Event and Luncheon (Armory Building, Moses Lake) 1:00 p.m.—1:30 p.m. Open Record Public Hearing, Ordinance Imposing a 6 month Moratorium on the Establishment of Marijuana Production and Sales, as Authorized by Initiative 502 The Commissioners held an Open Record Public Hearing to consider an Ordinance imposing a six month moratorium on the establishment, location, permitting, licensing, or operation of marijuana production, processing, and retail to the extent authorized by Initiative 502 or applicable law. Damien Hooper, Planning Director, discussed the WA State Liquor Control Board (LCB) ruling and the process the County must go through to change the Comprehensive Plan. He stated the Liquor Control Board adopted their rules mid-October. The 6 month moratorium will allow the Planning Department to address issues within the zoning code and get the recommendation to the Planning Commission. Chris Brown, Nahcotta,WA asked questions of the Commissioners and spoke in favor of I-502 and against the moratorium. He stated the people have implemented this law and the Commissioners have no right to interfere. The application process begins November 18, 2013 for the LCB to issue licenses; there is a 30 day window for the completion of this process, Mr, Brown provided the Commissioners copies of his speech and a letter from the Department of Justice. � Page 5 of 6 � Grant County Commissioners Minutes � Week of November 11, 2013 ' Amy Dalluge, Grant County, spoke in favor of I-502 and against the moratorium and asked what we can do to move forward with this new law, She stated the law will create jobs and revenue for the County. She believes if the County implements this moratorium they can expect a ; lawsuit.The County should have made this more of a priority. Stuart Chisholm, Goldendale, WA spoke in favor of I-502 and against the moratorium. He states that I-502 is a great investmen�C opportunity for everyone in the state of WA, It will create many jobs. This was passed a year ago and there has been plenty of time to go over the rules. Commissioner Stevens stated the County wants to use the 6 month moratorium to get the regulations ciphered through our County Code. If a person came in to get an application right now you wouldn't be able to get a permit because we don't have this in our codes, To get this through our codes we have to bring this before the Planning Commission. The County is not talking about stopping this,just setting up for it. Carolann Swartz stated the County wants to get the rules right the first time and not have to go back and mal<e many changes. Mr. Chisholm stated the people interested in the application must have a permanent address to put on the LCB application. Ted Holbert (?), Bonney Lal<e, is in Grant County to lease land to establish a tier 3 grow operation. He spoke in favor of I-502 and against the moratorium. He stated that January 2015, ' the state plans to close all medical marijuana dispensary's, grows, and processing facilities. He discussed an article in the Seattle times about a 5 year old boy whose family uses medical marijuana to ease his son's seizures (he presented this article to the BOCC). Nick Wallace, Attorney, representing many of the agriculture citizens in Grant County. He states his clients are wondering how to get involved into this market. His understanding that the , moratorium is being proposed so that the Grant County Code could be updated. He stated it appears that this is a vehicle for delaying this based on the personal preferences of the County Commissioners. He read from an ar�icle published on iFiber news where it states "Grant County officials are looking for a way to avoid allowing marijuana retailers to set up shop". He believes this moratorium will put his clients at a disadvantage. He thinks a shorter moratorium, if any, would be better. Discussion ensued. Commissioner Swartz stated she will be meeting with other County Commissioners from across the state at the WSAC conference next week and there will be much discussion on this issue. Mr. Wallace stated that many people read the iFiber article that stated Grant County will not be a marijuana friendly county, Commissioner Carter stated it was she that made the quotes, not the other commissioners. Commissioner Stevens stated that Grant County and the East side of the state turned down I-502. Joel Martin, Ephrata, spol<e in favor of I-502 and against the moratorium. He stated all governmental entities have had 30 days since the final adoption of I-502 and that should have been enough time to get this together. He believes that most of the grow operations will be indoor operations because of the risk of pesticides being sprayed on the marijuana. Commissioner Swartz seconded and the motion passed unanimously. Commissioner Stevens i moved to continue the hearing to November 26, 2013 at 10:30 a.m. Commissioner Swartz i seconded and the motion passed unanimously.
