GRANT COUNTY BOARD OF COMMISSIONERS
MONDAY. APRIL 4,2011:
The Grant County Commissioners session began at 8:3o a.m. with all Commissioners in attendance.

A motion was made by Commissioner Carter, seconded by Commissioner Stevens, to approve items 1
through 3 and items 11 and 12, on the ASC Agenda as presented below. Items 4 through 10 are being held
for further review. The motion passed unanimously.
i. Possible vouchers for Interfund Communications, insurance, and/or
grant administration. (Approved)
2. 2011 Agreement Regarding Use of County Property for Public Use
between Grant County and the Ephrata Chamber of Commerce, Inc.
for the Basin Summer Sounds Music Festival set up, activities, and
tear down July 14 — 17, 2011. (Approved)
3. Interagency Data Sharing Agreement between Grant County and the
Grant County Housing Authority for shared access of Homeless
Management Information Systems (HMIS) data for the purposes of
oversight and administration on the active Homelessness Prevention
and Rapid Re -housing (HPRP) and Homeless Grant Assistance
Program (HGAP) grants. (Approved)
4. Geographic Information Interlocal Agreement between Grant County
and the City of Moses Lake for access to bi-monthly/monthly
updates of spatial and tabular data as maintained by the County via
on-line ftp site or quarterly updates of spatial and tabular data as
maintained by the County via CD/Rom or DVD. Term is January 1,

5. Geographic Information Interlocal Agreement between Grant County

12. 2011Animal Shelter Contract between Grant County and Grant
County Animal Outreach to provide animal shelter services for all
Animals for which impounding or quarantine is authorized by the
County. Grant County will provide GCAO the annual amount of
$38,00o.00 for the term of the contract January 1, 2001 through

6. Public Utility District No. 2 of Grant County Electrical Application
Fee in the amount of $10,922.00. (Held for further review,

Mental Healthcare to grant up to 3 large truckloads of trash/debris to
be taken to the landfill at no cost to assist a client of Grant Mental

the amount of $146,350.23 for the Boarding Home Project.

Elected Official and Department Head Luncheon
Grant County Paper of Record for 2010 -eon Decision
A motion was made by Commissioner Stevens, seconded by Commissioner Carter to award the
bid for 2011-2012 legal notice publishing to the Columbia Basin Herald in the amount of 51.99
per column inch. The motion passed unanimously.
2:00 P.M. — 2:50 P.M. T Hechler, Human Resources Update
3:00 p.m. — 3:20 P.M. Open Record Public Hearing, Ordinance adding Ch. 11 to the Grant
County Code titled "Operation of Golf Carts"
The Commissioners held an Open Record Public Hearing to consider an Ordinance adding Ch. it
to the Grant County Code titled "Operation of Golf Carts" which will regulate the use of Golf Carts
(or similar vehicles) on Public Property in Grant County.
Gary Varney — Desert Aire Homeowners Association - Spoke of his concerns to the proposed
Ordinance. Their #1 concern is there was no provision for operating times as set in the State
Legislature. #2 they would like to see provision for seatbelts and reflective mirrors. There are no
guidelines for those provisions. #3 State Law does not require inspection, but the County, is going
to require inspections. State law gives the opportunity to issue a decal for the cart and they are in
support of that. They do not believe that a yearly inspection should be required. #4 there is no
language on Golf Cart signage for roads within the zone (entrance and exit signs).
Carolann Swartz stated that the Ordinance is establishing the zones, not the regulation of the golf
carts.
Dave Ponozzo, Undersheriff, stated that signage is on its way. He stated that Golf Carts are easily
modified that is why yearly inspection is required. Sgt. Kriete has an inspection form that will be
passed out to local home owners associations. The GCSO will go to the 3 areas that have
requested to be included in the golf cart zone approx. 3 times a year for inspections. State law
does not state that you can only use the carts during the day, but that each county can regulate the
hours of operation. The Sheriffs Office has no desire to regulate the hours of operation, but if one
is being used during the night, it must have head and tail lights.

Don Tracy Golf Professional at Desert Aire, stated that all new Golf Carts have identifying ID
numbers, just like serial numbers. Undersheriff Ponozzo stated that the VIN number is the best
way to identify the carts.
Commissioner Carter thanked the Sheriffs Office, Auditor, and Public Works for all of their hard
work.
Steve Bodin — Desert Aire, read into the record a letter to the BOCC as a private citizen and
believes this Ordinance is unnecessary. Mr. Bodin discussed his Neighborhood Electric Vehicles
(NEV). These look and run like golf cart, but are not subject to any county regulations. He is
wondering if requiring this inspection will violate their 4th amendment, unlawful search. He
stated that the word "inspection" is not written in the legislation.
Commissioner Stevens moved to close the public comment portion of this hearing, Commissioner
Carter seconded. This motion was held due to a member of the public desiring to speak.
Gary Varney asked if we move forward with this ordinance, what is the timeframe?
Dave Ponozzo stated Sgt. Joe Kriete will be in charge of this with the Motor Traffic Unit and they
hope to have it in place before Memorial Day weekend.
Jack Kling stated that the Sunland Estates Homeowners Association is in support of the passing
of this Ordinance. The motion to close the public comment period passed unanimously.
Commissioner Carter moved to approve the Ordinance as presented, Commissioner Stevens
seconded and the motion passed unanimously. The hearing adjourned.

MISCELLANEOUS ITEMS
The Commissioners approved the request of New Hope Domestic Violence and Sexual Assault Services to
hold their "Clothesline Project' at the Ephrata Courthouse Complex.
As of this date, the Board, by a majority vote, does approve for payment those vouchers certified by the
auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified by the
auditing officer as required by RCW 42.24.090, in the amount of $387,545.65, as recorded on a listing
and made available to the Board.

Change
The Commissioners held a Closed Record Public Hearing regarding a Reasonable Use Exception
application from Kent and Heidi Gephart to allow the development of a single-family dwelling on
a 2.61 -acre parcel in the Agricultural (AG) Zone of Grant County. The existing parcel does not
meet the current density requirements of the AG Zone, 1 dwelling unit per 4o acres. The property
location north of Mae Valley Road, west of Road E and east of Road D and is in a portion of S 23,
T 19 N, R 27 E, WM, Grant County, WA (Parcel #21-1324-002). Commissioner Stevens moved to
uphold the recommendation of the Planning Commission and approve the application as
presented recognizing the 1 Conditions of Approval and 6 Findings of Fact. Commissioner Carter
seconded and the motion passed with unanimously. The hearing adjourned. (Resolution No.

between Grant County and Rowand Machinery Co., Pasco, WA for (1)

3. Request for Reimbursable Work from the Bureau of Reclamation to

The Commissioners held an Open Record Public Hearing to consider a petition to vacate Rd T -
SW (located in the NW quarter of S 26, T 18 N, R 23 E, W M) and Rd 4 -SW (located in the SW
quarter of S 23 and NW quarter of S 26, T 18 N, R 23 E, W M) from David Niderost. Derek Pohle,
Public Works Director read into the record his County Engineers report. Dave Niderost —
Proponent, discussed his application. Commissioner Carter moved to close the public comment
portion of the hearing. Commissioner Stevens seconded and the motion passed unanimously.
