A CERTAIN COUNTY ROAD 9 SE Order Granting Vacation
ROADLOG 20520 BMP 8.07 to EMP g
8.52 in Exchange for Easement
WHEREAS, the Board of County Commissioners of Grant County, Washington,
has received a petition to vacate portions of certain County Road Right -of -Way described
as follows:
Legal description: That portion of County Road and Right -of -Way known as 9 SE,
Roadlog 20520 BMP 8.07 to EMP 8.52, A 60 foot wide strip of land lying in the NE1/4 of
Section 21, Township 17 N, Range 28 E.W.M, Grant County, WA, the Centerline of said
60 foot wide strip being described as follows:
Commencing at the NE Corner of said Section 21; Thence S00046'24E along the East
line of said Section 21, A Distance of 1487.30 ft. to the Point of Beginning, said Point
being the Beginning of a Non -Tangent Curve to the Left, the Radius Point of which Bears
S89013'36"W 260 ft.; Thence Northwesterly along said curve through a Central Angle of
63°23'07", an Arc Length of 287.63 ft.; Thence N 64°09'31 "W 2116.63 ft.; to the beginning
of a Tangent Curve to the Left having a Radius of 200 ft.; Thence along said curve
through a Central Angle of 19°52'08"; and Arc length of 63.36 ft.; Thence North
84001'39"W 27.73 ft., more or less, to the Easterly Right of Way Margin of'H' Rd SE, Also
being the Terminus of this Centerline. Said Terminus Point bears South 81038'39"W
2148.44 ft. from the NE corner of said Section 21, as shown on Attached Exhibit A,
labeled as "AS BUILT EXISTING ROAD 9 S.E.";
WHEREAS, the Board of County Commissioners has determined that
consideration should be given to vacating portions of certain County roads and
rights-of-way and directs the County Road Engineer to prepare a report on the vacation
and abandonment.
WHEREAS the vacation shall not become effective until the Right -of -Way
Easement, Attached (unrecorded) Exhibit B; also labeled as "ROAD 9 S.E. REVISED
LOCATION" on Attached Exhibit A has been duly recorded, AND said road being built to
Grant County Road Standards AND accepted by the Grant County Engineer.
WHEREAS, a notice of hearing on the report for vacation and abandonment was
published in the County official newspaper at least once a week for two consecutive
weeks preceding the date fixed for the hearing, and a copy of said notice was posted for
at least twenty days preceding the date fixed for hearing at each termini of the county road
or portion thereof to be vacated or abandoned; and
WHEREAS, the Board of County Commissioners did consider the report given by
the County Road Engineer, together with any evidence for or objection against said
vacation and abandonment; and
WHEREAS, the above described County easement is not useful as part of the
County road system and the public will be benefitted by the vacation and abandonment.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners
vacates and abandons all interest in the County road easement described above;
EXCEPT an easement along the vacated right-of-way to accommodate existing power
lines, communications lines and other franchised and/or permitted public and private
utilities.
