T Hechler, Human Resources Update The Grant County Commissioners session was called to order at 8:3o a.m. with all the Commissioners in attendance with the Clerk of the Board. J STRICKLER ASC UPDATE AND MISC. BOCC ACTION A motion was made by Commissioner Swartz, seconded by Commissioner Stevens, to approve items 1 and 2 on the ASC Agenda. The motion passed unanimously. COMMISSIONERS WORK SESSION A motion was made by Commissioner Stevens, seconded by Commissioner Swartz, to approve items 1 through 4 on the Work Session agenda. Items 2 and 4 were set for public hearing on September 7, 2o10 at 9:3o a.m. The motion passed unanimously. COMMISSIONERS' AUGUST 2, 2010 MINUTES Page 2 of 5 MISCELLANEOUS ITEMS As of this date, the Board, by a majority vote, does approve for payment those vouchers certified by the auditing officer as required by RCW 42.24.o8o, and those expense reimbursement claims certified by the auditing officer as required by RCW 42.24.090, in the amounts of $8,249.03 and S761,622.17, as recorded on a listing and made available to the Board. As there was no further business to come before the Board the session was continued until August 3, 2010. A Lee, Prosecuting Attorneys Office Update 3:30 P.M. — 3:45 P.M. Consent Agenda The session was continued at 9:oo am with all the Commissioners in attendance with the Clerk of the Board. CLOSED RECORD PUBLIC HEARING JOSEPH BYRD MINOR ZONE CHANGE The Commissioners held a Closed Record Public Hearing regarding an application from Joseph Byrd for a zone change of 21.04 acres from Agriculture to Rural Residential 1. The comprehensive plan land -use designation for this property was changed as part of the 2008 amendment cycle. The site is located on Rd 20 -NE approx. 3 miles east of the City of Soap lake. The proposal is in a portion of the NE quarter of S 27, T 22 N, R 27 E, W.M., Grant County, WA (Parcel #20-0051-001). Commissioner Swartz moved to uphold the Planning Commission recommendation and approve the application as presented, recognizing the 10 Findings of Fact. Commissioner Stevens seconded and the motion passed unanimously. The hearing adjourned. (Ordinance No. 10 -o59 -CC) OPEN RECORD PUBLIC HEARING ORDINANCE AMENDING CH 6.-18 OF THE GRANT COUNTY CODE TITLED GRAFFITI ABATEMENT CODE The Commissioners held an Open Record Public Hearing regarding the Ordinance Amending Ch. 6.38 of the Grant County Code Titled Graffiti Abatement Code. D. Angus Lee gave a brief synopsis of the Ordinance he has presented to the Board for approval. It adds section 6.38.100 titled Tagging and Graffiti — Spray Paint. Violation of the code would be as follows: COMMISSIONERS' AUGUST 2, 2010 MINUTES Page 3 of 5 1. imposing a minimum imprisonment sentence of 3o days but not more than 1 year; 2. or upon request from the defendant the court may convert jail time to community service hours with each individual day of jail sentenced being equal to eight hours of community service 3. Such sentence must run consecutive to any other sentence. Nick Wallace, Schulteis Tabler and Wallace, spoke in support of the Ordinance amendment. Bill Birney — Ephrata, has recently been "tagged" and spoke in favor of the change, but stated that he doesn't feel he should be responsible for the removal. The person doing the tagging should be responsible. Nita Whitver — Ephrata, does not feel the ordinance goes far enough. She believes that "regular" paint should also be named, not just spray paint. She also objects to the 3o days imprisonment should not be able to be turned into community service. Prosecutor Angus Lee gave a speech to those in attendance. Commissioner Stevens noted for the record written comments submitted to the Board. The Sheriffs Office raised concerns of payment of the jail sentence. Commissioner Stevens moved to close the public comment of the hearing, Commissioner Swartz seconded and the motion passed unanimously. (Ordinance/Resolution No. 10-o6o-CC) D POHLE PUBLIC WORKS UPDATE The Commissioners approved and signed the out of state travel request for Jerome Wawers to attend the Pacific Northwest Bridge Maintenance Conference in Seaside, OR from October 19-21, 2010. The Commissioners signed a 30 Year Dedicated Service Award for Victor J. Levesque for his outstanding service to Public Works. CONSENT AGENDA Commissioner Swartz moved to approve the Consent Agenda, Commissioner Stevens seconded and the motion passed unanimously, as presented below: COMMISSIONERS' OFFICE: Commissioners Office Vouchers Special Occasion license application for the Grant County Fair Association, 3953 Airway Dr NE, Moses Lake, WA 98837; the Samaritan Healthcare Foundation, 8oi E Wheeler Rd, Moses Lake, WA 98837; and the Wenatchee Eagles #204,1208 N. Wenatchee Ave., Wenatchee, WA from the Washington State Liquor Control Board. AMENDED designation of the County Legislative Authority to Serve on Canvassing Board: the Chair of the Board designates Commissioner Carolann Swartz to serve as the County Legislative Authority on the Canvassing Board for the time frame of the delegation which is August 1 - September 1, 2010. HUMANRESOURCES Personnel Action Request Recommendation regarding Juvenile Court's request for an exception to the hiring freeze to hire a Qualified Court Interpreter. The Director recommends approval.
