Resolution/Ordinance No. 07 - 09�- CC
An Ordinance Relating to the adoption of Interim Official Controls
temporarily amending the Unified Development Code (UDC) by temporarily
implementing interim Zoning designations consistent with the Land Use
Designations approved by the Eastern Washington Growth Management
Hearings Board, as adopted in Resolution 04 -007 -CC, and other matters
properly relating thereto.
RECITALS:
WHEREAS, the Board of County Commissioners (the `BOCC") intends to comply fully
with the orders and directives of the Eastern Washington Growth Management Hearings Board
(the "Board") issued in case Nos. 99-1-0016 and 99-1-0019; and
WHEREAS, RCW 36.70A.390 provides for adoption of interim zoning controls for one
or more six-month periods provided Grant County (the "County") holds a public hearing on the
proposed Interim Zoning Ordinance and findings of fact are made prior to the renewal; and
WHEREAS, the Eastern Washington Growth Management Hearings Board has
dismissed the final remaining appeals in case Nos. 99-1-0016 and 99-1-0019 filed against the
County's Comprehensive Plan; and
WHEREAS, the Eastern Washington Growth Management Hearings Board has found
the Limited Areas of More Intensive Rural Development (LAMIRDs) and associated Land Use
Designations in Resolution 04 -007 -CC to be GMA Compliant; and
WHEREAS, the County fully intends to continue and complete the work plan to bring
the LAMIRDs into full compliance with the Final Decision and Orders of the Board and the Act
through the amendment and adoption of an updated Zoning map in order to implement
Resolution 04 -007 -CC; and
WHEREAS, it is the intent of the BOCC that this interim measure be in effect for a short
period of time. However, if additional time is necessary, it is also the intent of the BOCC to
maintain compliance with the Board's decisions through the extension of this ordinance.
NOW, THEREFORE, The BOCC does hereby ordain and establish interim
development regulations and adopts by reference Resolution 04 -007 -CC, and establishes interim
zoning designations that are consistent with and implement the Land Use Designations adopted
in Resolution 04 -007 -CC.

NOW THEREFORE BE IT FURTHER ORDAINED, the effective date of this
ordinance shall be: 11:59 p.m. 12:01 a.m. March 22, 2007, through 12:01 a.m. September 22,
2007.
In the event an additional extension is necessary, the BOCC hereby tentatively schedules
a Public Hearing for September 4, 2007, at 1:30 p.m., in the Grant County Courthouse, Board of
County Commissioners Hearings Room, Ephrata, Washington. Grant County Ordinance No. 06-
234 -CC is hereby repealed, effective March 22, 2007, at 11:59 pm.
NOW THEREFORE BE IT FURTHER ORDAINED, that at such time the Board of
County Commissioner's approve "final amended Zoning Designations" implementing
Resolution 04 -007 -CC prior to the expiration of this Ordinance, this Ordinance shall be null and
void.
PASSED by the Board of Grant County Commissioners in regular session at Ephrata,
Washington, by the following vote, then signed by its membership and attested by its Clerk in
authorization of such passage.
