WHEREAS, the Board of County Commissioners of Grant
County have been advised by the Grant County Planning Commission that an open
record public hearing was conducted on February 1, 2006, at 7 00 pm, on the matter of
creating three lots from Lot #5 of the replat of Desert Aire Condominiums, located in a
portion of Section 22, Township 14 North; Range 23 East, Willamette Meridian, Grant
County, Washington, (Parcel #02-1694-000) and,
WHEREAS, the Grant County Planning Commission on February 1, 2006, made
a unanimous recommendation of approval to the Board of County Commissioners, and,
WHEREAS, the Grant County Board of County Commissioners held a closed
record public hearing on,
2006; and,
WHEREAS, the Board of County Commissioners have made a decision to
uphold the recommendation to approve the proposed plat alteration contingent upon
conformance with the conditions of approval listed herein and in the staff report
presented by the Project Planner, and,
WHEREAS, the Board of County Commissioners have been advised by the
Planning Department that the subject parcel currently is vacant, and,
WHEREAS, the Board of County Commissioners have been advised by the
Planning Department that the subject replat was processed in accordance with the
requirements of the Grant County Code, Chapter 22 04 "Subdivisions and Plats," Chapter
23 12 "Development Standards," and Chapter 25.04 "Permit Application Review
Procedures," and,
WHEREAS, the Board of County Commissioners have been advised by the
Planning Department that pursuant to Grant County Code, Chapter 24.08, critical areas
review was performed and that the subject parcel does not appear to lie in any designated
areas and,
WHEREAS, the Board of County Commissioners has found that the subject
proposal lies in the Rural Village Residential 2 Zoning District and corresponding
Comprehensive Plan Land -Use Designation and thus is consistent with the underlying
zoning district as required by Grant County Code and RCW 36.70A; and,
WHEREAS, the Board of County Commissioners have found that the public use
and interest will apparently be served by the replat, and,
WHEREAS, the Board of County Commissioners have found that the proposal
will not adversely effect the health, safety, and general welfare of the public in the
vicinity of the proposal; and,
NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Board of
County Commissioners for Grant County, Washington, approves by this Resolution, a
plat alteration to create three lots from Lot #5, Desert Aire Condominiums located in a
portion of Section 22 Township 14 North, Range 23 East, Willamette Meridian, Grant
County, Washington; (Parcel #21694000), and,
CONDITIONS OF APPROVAL:
1) The Proposal shall be in compliance with the Grant County Comprehensive Plan,
the Grant County Unified Development Code, the Growth Management Act, the
Washington State Environmental Policy Act, the Grant County Unified
Development Code, the Grant County Resource Lands and Critical Areas
Development Ordinance and all other applicable federal, state, and local
regulations, rulings or requirements
2) Proposal shall comply with all requirements deemed necessary by the Grant
County Health District, the Washington State Department of Health, and the
Washington State Department of Ecology regarding domestic water supply,
sewage systems and storm water control and treatment including, but not limited
to; RCW 90 48.080 Discharge of Polluting Water Prohibited; WAC 173-201,
Surface Water Standards, WAC 173-201A, Ground Water Quality Standards;
and, WAC 246-272, On -Site Sewage Systems
3) Proposal shall comply with all requirements of the Grant County Fire Marshal and
shall comply with the Grant County Fire Flow Guidelines, the Uniform Building
Code, Uniform Fire Code and all other applicable requirements for fire protection.
4) If any Native American Grave site(s) or archaeological/cultural resources (Indian
Artifacts) are found, all construction activity shall stop and the owner/developer
shall immediately notify the Grant County Planning Department, the Colville
Tribe, and the Washington State Office of Archaeology and Historic Preservation.
5) Preliminary Re -plat approval shall be contingent upon conformance with all
applicable land use rules and regulations in effect per the Unified Development
Code
6) Development shall comply with Grant County Unified Development Code
Chapter 22 04 Article 5 "Final Subdivisions and Short Subdivisions "
7) Development shall comply with all requirements of the Grant County Auditors'
Office
8) Development shall comply with all requirements of the Grant County Public
Works Department including but not limited to.
A) Provide replat check fee of $100 00
B) Provide a vicinity map with all local access roads.
C) A plat certificate is required for dedicated lands.
D) An approach permit must be obtained prior to a building permit
E) Plat should be labeled as a Replat not a Short Plat
F) The private road easement shall be recorded with the Grant County
Auditor's office and the records file number shall be placed on the face of
the plat.
G) A note shall be placed on the face of the plat restricting the access of all
Lots contained in this plat onto the private road. Also a shaded/hatched
area shall be placed along the boundary of Lot 1 and Desert Aire Drive as
a visual representation of the restrictive access note
FINDINGS OF FACT
1. Meets the applicable requirements of UDC Chapter 22 04 "Subdivisions and Plats";
2 Serves the public use and interest,
3. Complies with the Comprehensive Plan, the Shoreline Master Program, the zoning
code and other land use regulations, and SEPA,
4. Complies with Health District requirements for sewage disposal and potable water
supply,
5. Contains an accurate legal description of the lots being created, and the roads and
easements therein,
6 Complies with Grant County and, where applicable, State Department of
Transportation regulations pertaining to roads, utilities, drainage, access for
emergency vehicles, and other infrastructure improvements;
