IN THE MATTER OF DECLARING
SURPLUS AND SELLING LOTS 1 Resolution No. 2005-a9l-CC
THROUGH 7, QUINCY ORIGINAL PLAT FINDINGS AND DETERMINATIONS
WHEREAS, The Board of County Commissioners has the authority to sell real property through
RCW 36.34, and
WHEREAS, it appears to the Board of County Commissioners that it is in the best interests of
the county and the taxing districts and the people thereof that Lots 1 through 7, Quincy Original Plat,
should be declared surplus and sold under the limitations and restrictions and in the manner prescribed by
law, and
WHEREAS, the County Road Engineer did publish notice of the Board of County
Commissioners's intention to declare surplus and sell the described real estate once each week during
two successive weeks in a legal newspaper of general circulation in the county, and posted the notice in a
conspicuous place in the courthouse Both posting and the date of first publication occurred at least ten
days before the day set for the hearing, and
WHEREAS, a hearing on the proposal to declare surplus and sell Lots 1 through 7, Quincy
Original Plat, occurred in the Board of County Commissioners Hearing Room, located in the County
Courthouse, 35 C Street NW, Ephrata, WA, at 2:00 P.M. on November 1, 2005, and all taxpayers in
person or by counsel were allowed to submit evidence and submit an argument, and
WHEREAS, the Board of County Commissioner's may dispose of county property to another
governmental agency, in this case the City of Quincy, by means of private negotiation upon such terms as
may be agreed upon and for such consideration as may be deemed by the board of county commissioners
to be adequate
NOW, THEREFORE, BE IT RESOLVED, the Board of County Commissioners finds that it is in
the best interests of the county and the taxing districts and the people thereof that Lots 1 through 7,
Quincy Original Plat, belonging to the county shall be declared surplus and sold under the limitations and
restrictions and in the manner prescribed by law and the receipts from the sale be deposited in the County
Road Fund
BE rr FURTHER RESOLVED, the County Road Engineer is directed to enter into negotiations
with the City of Quincy for the sale of the described real estate and present the terns of the negotiations
and Quit Claim Deed to the Board of County Commissioner's for approval by resolution to be spread
upon the minutes of the Board of County Commissioners and made public record, and that the Quit
Claim Deed be recorded with the County Auditor.
