AN ORDINANCE/RESOLUTION AMENDING SECTION
11.30.030 OF THE GRANT COUNTY CODE, TO PERMIT THE
OPERATION OF AN ORV IN AREAS DESIGNATED FOR
PUBLIC ORV USE IN GRANT COUNTY TO CARRY
PASSENGERS AND, OTHER MATTERS PROPERLY RELATING
THERETO.
RECITALS:
WHEREAS, the Board of County Commissioners and the Grant County Sheriffs Office
desire to protect the public health, safety, welfare and property of the residents of Grant County and
visitors, who utilize the areas designated for public ORV use in Grant County; and
WHEREAS, members of the Grant County Sheriffs Office have observed the hazards and
the potential for hazards to users of the areas designated for public ORV use in Grant County for
recreational purposes; and
WHEREAS, the Grant County Sheriffs Office has recommended that, due in part to
advances made in the development, design and construction ofORVs by manufacturers, the existing
prohibition against carrying passengers be deleted from the Grant County Code (GCC); and
WHEREAS, the Board of County Commissioners previously passed an ordinance enacting
violations for the use of ORVs in areas designated for public ORV use in Grant County codified in
GCC 11 30.030, and said ordinance should be amended consistent with the recommendation of the
Grant County Sheriffs Office, NOW, THEREFORE, IT IS HEREBY:
ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT
COUNTY, STATE OF WASHINGTON, THAT GCC 11.30.030 BE AMENDED BY
DELETING PARAGRAPH (2), WITH SUBSEQUENT PARAGRAPH NUMBERS
ADJUSTED ACCORDINGLY.
Section 1. GCC 11.30.030, adopted by Ordinance/ResolutionNo.91-123-CC,onSeptember23,
1991, is hereby amended by deleting paragraph (2), with subsequent paragraph numbers adjusted
accordingly, to read:

11.30.030 Violations.
It is unlawful:
(1) For any person to operate or ride an ATV, ORV, or motorcycle in any area designated
for public ORV use in Grant County, or in any area open to the public, unless wearing upon
his or her head a protective helmet of a type conforming to the Federal Department of
Transportation standards for motorcycle street use;
(3)(Q For any person to operate an ATV, ORV, or any other vehicle, excluding
motorcycles, in any area designated for public ORV use in Grant County not equipped with a
flag for added visibility, a bright red or brilliant orange color, measuring at least forty-eight
inches square, mounted on a pole placing the flag a minimum of one hundred eight inches
above the ground when the vehicle is stationary. Such flag shall be displayed as to be visible
from all directions, maintaining nearly all of the required height when the vehicle is in
motion;
(4)(D Exemptions.
(a) The following areas are exempt from the provisions of subsection (3) Q of this
section at all times:
(A)(i) Sand Dunes Road and the parking areas immediately adjacent to it in the
Moses Lake Sand Dunes;
(u) Powerlines Road and the parking areas immediately adjacent to it in the
Moses Lake Sand Dunes;
(iii) The primary entrance roads and the camping areas for all ORV areas for
public use In Grant County, except for the Moses Lake Sand Dunes;
(B) Any operator or rider of a vehicle will not commit an additional violation of
this ordinance while returning directly to his or her campsite or starting point,
after receipt of a citation;
(C) Any operator or rider of a vehicle acting under the direction of law
enforcement will be exempt for the provisions of this chapter.
Section 2. This ordinance/resolution shall take effect the /25 day of June, 2006.

NOW THEREFORE, BE IT HEREBY RESOLVED THAT THE GRANT COUNTY
COMMISSIONERS adopt this ordinance/resolution.
