HomeMy WebLinkAboutResolution 06-175-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF 74.35 ACRES INTO THIRTEEN LOTS FOR VLADIMIR BEREGOVOY, LOCATED IN A PORTION OF S 02, T 21 N, R 26 E, & S 035,T22N, R 26 E, WM, GRANT, WA RESOLUTION No. 2006-/75CC APPROVING A PRELIMINARY PLAT OF BER ESTATES NO. 1 WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on May 3, 2006, on the matter of a preliminary plat of —74 35 - acres into thirteen lots; located in a portion of Section 2, Township 21 North, Range 26 East, and Section 35, Township 22 North, Range 26 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission did approve a motion to recommend to the Board of County Commissioners to approve the proposed preliminary plat with seventeen (17) conditions of approval and twelve (12) findings of fact affirming the recommendation; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on June 6, 2006; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does meet the applicable requirements of Grant County Unified Development Code Chapter 22.04 "Subdivisions and Plats'; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does serve the public use and interest; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Grant County Comprehensive Plan, the Shoreline IN THE MATTER OF APPROVING A VLADIMIR BEREGOVOY PRELIMINARY PLAT OF 74.354 ACRES BER ESTATES NO. 1 INTO THIRTEEN LOTS Master Program, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have found that the "Best Available Science" has been considered in the final decision regarding the proposed subdivision, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the requirements of the U S. Department of Interior, Bureau of Reclamation and the Quincy -Columbia Irrigation District; and, WHEREAS, the Board of County Commissioners have found that the phasing plan does include all land within the subdivision; and, WHEREAS, the Board of County Commissioners have found that each phase of the subdivision is an independent planning unit with safe and convenient circulation, and contains facilities and utilities that have been coordinated with the requirements established for the entire subdivision; and, WHEREAS, the Board of County Commissioners have found that all road improvement requirements are ensured pursuant to GCC § 22.04.450, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does appropriately identify and protect critical areas pursuant to GCC § 24.08; and, WHEREAS, the Board of County Commissioners have made a decision to approve "Ber Estates No. 1 Preliminary Plat." NOW, THEREFORE, BE IT RESOLVED THAT, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of —74 35 -acres into 13 lots; located in a portion of Section 2, Township 21 North, Range 26 East, and Section 35, IN THE MATTER OF APPROVING A VLADU%M BEREGOVOY PRELIMINARY PLAT OF 74.354 ACRES BER ESTATES NO. 1 INTO THIRTEEN LOTS Township 22 North, Range 26 East, Willamette Meridian, Grant County, Washington. (Parcel #'s 20-0117-000 & 20-0119-000); CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of March 20, 2006. 5) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 6) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage -ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 7) This proposal shall comply with the requirements of GCC 23.12 100 Road Standards, including but not limited to: a) Road names shall be approved by the Grant County Emergency Services Department and shall be established using the addressing and grid system delineated in GCC 10.36. IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF 74.354 ACRES INTO THIRTEEN LOTS VLADIMIR BEREGOV OY BER ESTATES NO. 1 8) Development shall comply with all requirements of Grant County Building Department/Fire Marshall including, but not limited to: a) A note shall be place on the plat stating, "All lots are subject to a 25' minimum setback from all property lines subject to verification by the Fire District for water availability." 9) Development shall comply with all requirements of the Grant County Health District including, but not limited to: a) Evaluation of soil and terrain conditions will be required before final approval of the plat will be given. 10) Development shall comply with all requirements of Grant County's Public Works Department including, but not limited to: a) Provide a plat review fee of $100 00 plus $2 00 a lot for a total of $126.00. b) Provide a plat certificate from the title company for all land being dedicated to Grant County. c) Provide a complete road plan and profile with all centerline data and drainage facilities for new roads. d) An Approach Permit shall be obtained for each lot prior to the issuance of a Building Permit. e) 30.00 feet of Right -Of -Way shall be dedicated along the north, east, and south boundaries of this plat. 60.00 feet of Right -Of -Way shall be dedicated along the mid-section line (boundary common to lots 3 and 4, and lots 10 and 11) for the future extension of County Road 18 -NW f) The intersection design for the intersection on the east boundary of this plat at the comer of lots 11 and 13 does not meet current design standards. This intersection shall be redesigned g) In order for the road to extend beyond lots 9 and 10, Grant County will need to know the future intension for that parcel. Also, this parcel would need to be incorporated into the plat at least for the purpose of dealing with Right -Of -Way issues. h) Additional Comments will be forthcoming as additional submittals are received. 11) Development shall comply with the requirements of the Grant County Assessor's office including, but not limited to: a) The final subdivision shall provide a signature line for Vladimir Beregovoy in addition to Duane Mitchell for all dedications. 12) Development shall comply with the requirements of the Grant County Emergency Services including, but not limited to: a) Roads will be designated to the grid system. b) Addressing must be posted for each lot as developed. 13) Development shall comply with the requirements of the Grant County PUD including, but not limited to: IN THE MATTER OF APPROVING A VLADIMIR BEREGOVOY PRELIMINARY PLAT OF 74.354 ACRES BER ESTATES NO. 1 INTO THIRTEEN LOTS a) The following note shall be added to the final plat, "All lots subject to a public utility easement 5' in width on all interior lot boundaries and 10' in width on all exterior lot boundaries." 14) Development shall comply with the requirements of the Quincy -Columbia Imgation District; including, but not limited to: a) The following requirements shall be met before the Irrigation District will sign the plat: i) The complete farm unit must be shown on the plat. ii) A useable irrigation right-of-way to the legal point of water delivery is to be drawn on the face of the plat. If access to the turnout cannot be obtained, the water must be released before the plat is signed. iii) Useable legal road access to all lots must be shown on the plat. Federal irrigation right-of-ways are not legal access and do not fulfill this requirement. All irrigable acres proposed for roads must be included in the adjoining lots in an equitable manner. iv) All Federal right-of-ways need to be shown on the plat. b) This plat subdivides land that has been isolated from the legal point of water delivery by previous land segregations. TheQuincy-Columbia Basin Irngation District (QCBID) considers further subdivision an escalation of the problem and will not sign the plat until the problems are resolved. 15) Development shall comply with the requirements of the US Department of Interior (Bureau of Reclamation) including, but not limited to a) Prior to final approval the following changes are required- a) The west side of Section 2, Township 21 North, Range 26 East is shown on the preliminary plat as N 00°11'49' W, however this bearing has been recorded on farm unit plat as N 00°11'50' W, this shall be corrected; and b) The Reclamation bearing and distance for the south boundary of Farm Unit 37 shall be shown as (N 89° 51" 49' E 1326.98'). b) All survey data on the Bureau of Reclamation Farm Unit maps pertaining to Reclamation facilities, associated rights-of-way, and farm unit boundaries within the area being subdivided shall be included on the plat. 16) Development shall comply with the requirements of the WA State Department of Ecology (DOE) including, but not limited to, compliance with DOE's Water Quality and Solid Waste Programs. 17) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non -Significance issued by Grant County on March 17, 2006. o IN THE MATTER OF APPROVING A VLADIMIR BEREGOVOY PRELIMINARY PLAT OF 74.354 ACRES BER ESTATES NO. I INTO THIRTEEN LOTS c) The location, width, and nature of "proposed utility easements" located along property lines shall be identified as a "note" and not drawn; furthermore, those cases where USBR and/or irrigation easements exist along property lines, the utility easements shall run parallel and abutting said easements, language shall be added to the easement note to reflect this. d) The developer shall be required to develop all proposed roads to County Public Road standards and dedicate them to the County at the time of development of the lots fronting those roads e) A note shall be added to the plat stating to which lot the remaining residential development potential will be allocated too. f) Development shall comply with the special setbacks for developments adjacent to Agricultural Zoning Districts as specified in GCC § 23.12.0700)(B) A note shall be placed on the face of the plat stating that any residential development on Lots 6, 7, 8, 9, and 10 shall be setback 100 feet from adjacent agnculturally zoned lots. This will consist of a 100' setback from the northern property lines of lots 6-9 and a 100' setback from the eastern property lines of lots 9 and 10. g) The date in the Auditor's certificate shall be changed to reflect the year 2006. h) All references to Short Plat in the NOTES shall be changed to Long Plat. i) The reference to the East Columbia Irrigation District in NOTE I on page four shall be changed to Quincy Columbia Irrigation District. j) The proposed cul-de-sac is located on a parcel outside of the project boundaries. Prior to final approval this issue shall be addressed. Dated this /'day of 2006.
