A RESOLUTION APPROVING THE CLINT
BROWN PRELIl41NARY REPLAT
APPLICATION. A REPLAT OF LOTS 1
AND 2, CASCADE HEIGHTS SHORT PLAT
LOCATED IN A PORTION OF SECTION
20, TOWNSHIP 19 NORTH, RANGE 28,
EAST, WXGRANT CO., WASHINGTON

WHEREAS, the Board of County Commissioners of Gram County have been advised by
the Grant County Planning Commission that an open record public hearing was conducted on
February 2, 2005 at 7:00 pm, on the matter of creating four lots from Lots 1 and 2 of the Cascade
Heights short plat, located in a portion of Section 20; Township 19 North; Range 28 Bast;
Willamette Meridian, Cascade Valley, Grant County, Washington; (Parcel Nos 31-2026-000 and
31-2027-000) and,
WHEREAS, the Grant County Planning Commission on February 2, 2005, made a
unanimous recommendation of approval to the Board of County Commissioners; and,
WHEREAS, the Grant County Board of County Commissioners held a closed record
public hearing on, March 15, 2005; and,
WHEREAS, the Board of County Commissioners have made a decision to uphold the
recommendation to approve the proposed plat alteration contingent upon conformance with the
conditions of approval listed herein and in the staff report presented by the Project Planner; and,
WHEREAS, the Board of County Commissioners have been advised by the Planning
Department that the subject replat was processed in accordance with the requirements of the
Grant County Code, Chapter 22.04 "Subdivisions and Plats," Chapter 23.12 "Development
Standards," and Chapter 25.04 "Permit Application Review Procedures;" and,
WHEREAS, the Board of County Commissioners have been advised by the Planning
Department that pursuant to Grant County Code, Chapter 24.08, critical areas review was
performed and that the subject parcel does not appear to lie in any designated areas
and,
WHEREAS, the Board of County Commissioners has found that the subject proposal
lies in the Urban Residential 2 Zoning District and corresponding Comprehensive Plan Land -Use
Designation and thus is consistent with the underlying zoning district as required by Grant
County Code and RaCW 36.70A;.and,
WHEREAS, the Board of County Commissioners have found that the public use and
interest will apparently be served by the replat; and, r

WHEREAS, the Board of County Commissioners have found that the proposal will not
adversely effect the health, safety, and general welfare of the public in the vicinity of the
proposal; and,
NOW, THEREFORE, BE iT HEREBY RESOLVED THAT the .Board of County
Commissioners for Grant County, Washington, approves by this Resolution, a plat alteration to
create four (4) lots from Lot #1 and 2 Cascade Heights Short Plat located in a portion of Section
20, Township 19 North; Range 28 East; Willamette Meridian, Grant County, Washington, and;
BE IT FURTHER RESOLVED, the Grant County Board of Commissioners has
adopted the following ten "Findings of Fact" established by the Planning Commission in support
of their recommendation for approval of this replat:
1. The proposed rezone will not be contrary to the intend or purposes and regulations of the
Grant County Code or the Comprehensive Plan;
2. The property in question is suitable for uses allowed under the zoning district;
3. Uses allowed under the proposed replat are compatible with neighboring land uses;
4. The proposed replat can be served by adequate facilities including access, fire protection,
water, storm -water control, and sewage disposal facilities;
S. Substantial changes exist to warrant an amendment to the current zoning district allowing
said replat;
6. A public need exists for the proposed replat. Public need shall mean that a valid public
purpose, for which the comprehensive plan and this chapter have been adopted, is served
by the proposed replat.
7. The proposed replat will not result in significant adverse impacts on the human or natural
environments that cannot be mitigated by conditions of approval;
8. The cumulative impact of additional requests for like actions (the total of the rezones and
replats over time or space) will not produce significant adverse effects to the
environment that cannot be mitigated by conditions of approval;
9. The pedestrian and vehicular traffic associated with the replat will not be hazardous to
existing and anticipated traffic in the neighborhood, and
10. The proposed replat does not include any allowable use or activity that would result in
the location of an incompatible use adjacent to an airport or airfield (RCW 36.70).
CONDITIONS OF APPROVAL:
1) The Proposal shall be in compliance with the Grant County Comprehensive Plan, the
Grant County Unified Development Code, the Growth Management Act, the Washington
State Environmental Policy Act, the Grant County Unified Development Code, the Grant
County Resource Lands and Critical Areas Development Ordinance and all other
applicable federal, state, and local regulations, rulings or requirements.

2) Proposal shall comply with all requirements deemed necessary by the Grant County
Health District, the Washington State Department of Health, and the Washington State
Department of Ecology regarding domestic water supply, sewage systems and storm
water control and treatment including, but not limited to; RCW 90.48.080 Discharge of
Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A,
Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems
A) The location of the well for each lot and a radius of 100 feet must be shown on the plat.
The radius of 100 feet may not extend beyond the plat boundaries unless a restrictive
covenant is established with the owner of the adjacent property.
B) A site registration will be required for each lot to determine the suitability for septic system
installation. The work must be completed by a licensed septic system designer or engineer
and be submitted to the Gram County Health District. Contact our office for names of
qualified designers.
3) Proposal shall comply with all requirements of the Grant County Fire Marshal and shall
comply with the Grant County Fire Flaw Guidelines, the Uniform Building Code,
Uniform Fire Code and all other applicable requirements for fire protection.
4) Many Native American Grave site(s) or archaeological/cultural resources (Indian
Artifacts) are found, all construction activity shall stop and the owner/developer shall
immediately notify the Grant County Planning Department, the Colville Confederated
Tribe, and the Washington State Office of Archaeology and Historic Preservation.
5) Preliminary Re -plat approval shall be contingent upon conformance with all applicable
land use rules and regulation in effect per the Unified Development Code.
6) Development shall comply with Grant County Unified Development Code Chapter
22.04 Article 5 "Final Subdivisions and Short Subdivisions."
7) Development shall comply with all requirements of the Grant County Auditors'
Office.
8) Development shall comply with all requirements of the Grant County Public Works
Department including but not limited to:
A) Provide replat check fee of $100. 00
B) An access permit will need to be obtained prior to a building permit
