HomeMy WebLinkAboutResolution 04-130-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION: IN THE MATTER OF APPROVING TI-iE PITTS FLEMING REPLAT OF LOT 3 OF JOHNSON SHORT PLAT, PRELIMINARY PLAT OF 8.1 ACRES INTO SIX LOTS. THE SUBJECT SITE IS LOCATED IN SECTION 15, TOWNSHIP 19 NORTH, RANGE 28, EAST, WM. GRANT CO. WA. RESOLUTION No. 2004-/'330 -CC A PRELIMINARY PLAT FOR R.M. FLEMING AND ROBERT PITTS APPROVING THE "PITTS FLEMING ESTATES" REPLAT OF LOT 3, JOHNSON SHORT PLAT WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on September 1, 2004, on the matter of a request for a preliminary plat, submitted by R.M. Fleming and Robert Pitts, of 8.1 acres into six lots; which are located in a portion of Sections 16, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on September 1, 2004 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat and; WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on �a - 1 !qtf--, 2004 for the Pitts Fleming Estates Major Plat, submitted by R.M. Fleming and Robert Pitts and, WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary plat; and, WHEREAS, the proposed preliminary plat meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, IN THE MATTER OF APPROVING THE PITTS FLEMING ESTATES REPLAT OF THE JOHNSON SUBMITTED BY SHORT PLAT CONTAINING 8 ACRES± ROBERT PITTS & INTO SIX LOTS R -M• FLEN 1NG WHEREAS, the proposed preliminary plat does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the proposed preliminary plat does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the preliminary Pitts Fleming Estates Major Plat, submitted by R.M. Fleming and Robert Pitts. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary replat of Lot 3 of the Johnson Short Plat, a 8 -acre parcel, into 6 lots; located in a portion of Section 16, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; CONDITIONS OF APPROVAL; 1, Development shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2. Development shall comply with all applicable requirements of the Grant County Fire Marshall, the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. All lot may be subject to 25' setbacks from new construction to property lines subject to verification of water availability for fire flow requirements. 3. Development shall comply with all conditions imposed by the Grant County Public Works Department including but no limited to: a) Provided a Plat Check fee of $100.00 plus 2.00 per lot for a total of $112.00. b) Access permit must be obtained before building permits. c) For the road to be accepted into the County Road system, the following items need to be done: • Verification of the surfacing depths of the Base Course and top course. This shall be done by a licensed engineer • It appears that the BST surfacing is substandard and some repairs and sealing are required. The road names shall be shown on the Plat and Vicinity Map. e) In the S.W. corner of Lot #6, the linetype with the dots shall be deleted f) All lots shall access off of the new road g) The well protection easement shall not be shown over the County right-of-way.. 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology, regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: site evaluations for septic systems, approved water system by the Washington State Department of Health. RCW 90,48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards and WAC 246-272, On - Site Sewage Systems, Performing a site evaluation and site registration for each lot by a certified septic system designer of licensed engineer, If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and historic Preservation. 6. Preliminary Plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of March 19, 2004. 7. Pursuant to GCC UDC Ch 23.12.040(e)(1)(C) The Applicant shall work with the City of Moses Lake to develop covenant language regarding the development of future street, water and sewer infrastructure requirements in favor of the City of Moses Lake. The Covenant shall be recorded and noted on the face of the plat. 8. Development shall comply with all requirements of the Grant County Auditors Office including but not limited to: a) The name should be "Pitts Fleming Estates", a Replat of Lot 3 Johnson Short Plat.
