RESOLUTION.
IN THE MATTER OF APPROVING A
PRELIMINARY PLAT OF 32 ACRES
INTO FORTY-NINE LOTS LOCATED
IN A PORTION OF SECTION 17,

APPROVING A PRELIMINARY
PLAT OF
WILLOW CREST
MAJOR PLAT
WHEREAS, the Grant County Board of County Commissioners have
been advised that an open record public hearing was conducted, before the Grant County
Planning Commission on September 1, 2004, on the matter of a preliminary plat of 32
acres into forty-nine lots; which are located in a portion of Section 17, Township 19
North, Range 28 East, Willamette Meridian, Grant County, Washington; and,
WHEREAS, the Grant County Planning Commission on September 1,
2004 did approve a motion to recommend to the Board of County Commissioners to
approve this proposed preliminary plat with fifteen (15) suggested conditions of
approval; and,
WHEREAS, the Grant County Board of Commissioners held a closed
record public hearing on October 12, 2004; and,
WHEREAS, the Grant County Board of Commissioners continued the
closed record public hearing to October 26, 2004; and,
WHEREAS, the Board of County Commissioners, have reviewed the
application file, staff report and Planning Commission minutes; and,
WHEREAS, the Board of County Commissioners have found that the
proposal will not adversely effect the health, safety, and general welfare of the public in
the vicinity of the proposal; and,
WHEREAS, the Board of County Commissioners have found that the
proposal is consistent with the Grant County Comprehensive Plan, the Unified
Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and,
WHEREAS, the Board of County Commissioners have found that the
public use and interest will apparently be served by the preliminary plat; and,
WHEREAS, the proposed preliminary plat meets the applicable
requirements of Unified Development Code, Chapter 22.04 "Land Division"; and,

Place can access on Valley and H -NE with 1 (one) access per two lots. Lot 38
shall access on Scott Road at the west end of the lot or on H -NE at the SE
comer of the lot. This information shall be shown on the face of the plat.
i) The Cul-de-sac's shall have a right-of-way radius of 60' and a finished surface
of 50'.
j) The center line of Valley Road at the intersection of Scott shall be corrected as
well as topography lines.
12) This proposal shall comply with all the requirements of the Grant County Emergency
Services, including but not limited to:
a) Road names shall be approved by the Grant County Commissioners.
b) Proponent will need to contact this office for addressing.
13) The Developer shall provide a sidewalk along the east side of Valley Road along lots
29, 26, 25, 24, 8, and 7.
14) Development shall comply with all requirements of the Grant County Health District,
including but not limited to:
a) A site registration application must be prepared for each lot, submitted to the
Health District, and the required fees paid. The work must be done by a
certified septic system installer or licensed engineer. A list of qualified
designers is available from the Grant County Health District.
b) This plat is within the water service area for the City of Moses Lake. Some
agreement with the city must be made to allow individual wells.
c) Each lot shall have a share well and the location of these wells and a 100'
radius well head protection area must be shown on the plat.
d) The plat shall contain the notice that no activities that could affect ground
water quality will be allowed within the 100' radius shown. The 100' radius
must be within the boundaries of the plat.
15) Development shall comply with all requirements of the Grant County Planning
Department, including but not limited to:
a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final
Subdivisions and Short Subdivisions.
b) Comply with all requirements listed in the SEPA Mitigated Determination of
Non -Significance issued by Grant County on August 11, 2004.
c) The following note or a note to this effect shall be placed on the face of the
Plat, "All lots subject to a public utility easement 5' in width on all interior lot
boundaries and 10' in width on all exterior lot boundaries. Said easement is
subject to being relocated upon request of the lot owner and with the
concurrence of the affected utilities. In those cases where USBR and/or
irrigation easements exist along property lines, the utility easements shall run
parallel and abutting said easements. "
d) A note shall be placed on the face of the plat designating Lot 49 as a Wetland
& Associated buffer/Open Space, which will have no potential for
development and will remain in its native state.

b) All development shalt ensure that soil erosion, and sedimentation of drainage -
ways will be controlled to prevent damage to adjoining properties.
c) Surface drainage shall not be directed to or discharged onto County Roads or
ditches within County right-of-ways unless approved by the County Engineer.
6) This proposal shall comply with the requirements of GCC 23.12.100 Road Standards,
including but not limited to:
a) Roads shall be approved by the Grant County Emergency Services
Department and shall be established using the addressing and grid system
delineated in GCC 10.36.
7) Approval of the plat shall be contingent upon conformance with all applicable land
use rules and regulations in effect as of July 15, 2004.
8) The applicant shall comply with GCC 23.12 with regard to the development of water
and sewer infrastructure —or— provide a covenant insuring future sewer and water
infrastructure, built to city standards, in favor of the City of Moses Lake.
9) The applicant shall comply with the requirements of the Bureau of Reclamation;
including but not limited to, the Bureau of Reclamation signature block should be
removed from the final plat.
10) Pursuant to the requirements of the Washington State Department of Fish and
Wildlife the developer shall develop and record codes, covenants, and restrictions to
minimally address the maintenance of Lot 49, the Wetland & Associated Buffer/Open
Space.
11) Development shall comply with all requirements of Grant County's Public Works
Department, including but not limited to:
a) Provide a plat check fee of $100.00 plus $2.00 per lot for a total of $198.00.
b) The Vicinity Map shall show the new Valley Road that was built in 2003.
c) A Plat Certificate from the Title Company is required for the right-of-way
dedicated to the County.
d) Access permits will need to be obtained prior to a building permit.
e) The Urban Access roads shall be built to current County Road Standards,
which call for 4" base course, 2" top course and a 2 shot BST driving surface
with a width of 32'. Roadway plans shall be submitted to the County for
approval by the County Road Engineer for all access roads and the re-
alignment of the intersection of H -NE and Scott Road.
f) Additional slope easements may be necessary for earthwork around Valley
Road and Blue Heron Drive to achieve the required sight distance and
geometry for the intersection.
g) The road names shall be verified by Emergency Services.
h) All lots that have frontage on Blue Heron Drive, Blackbird Loop and
Blackbird Place shall access from those roads only. All other lots except #38
that do not have frontage on Blue Heron Drive, Blackbird Loop and Blackbird

WHEREAS, the proposed preliminary plat does comply with the Health
District's requirements for sewage disposal and potable water supply; and,
WHEREAS, the proposed preliminary plat does contain an accurate legal
description of the lots being created, and the roads and easements therein; and,
WHEREAS, the proposed preliminary plat does comply with Grant
County regulations pertaining to roads, utilities, drainage, access for emergency vehicles,
and other infrastructure improvements; and,
WHEREAS, the Board of County Commissioners have made a decision
to approve the Willow Crest preliminary plat.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners for Grant County, Washington approve by this Resolution, with the
conditions of approval listed below, a preliminary plat of 32 -acres into forty-nine lots;
which are located in a portion of Sections 17, Township 19 North, Range 28 East,
Willamette Meridian, Grant County, Washington;
CONDITIONS OF APPROVAL:
1) Development shall be in compliance with the Washington State Environmental Policy
Act, the Grant County Comprehensive Plan, the Grant County Unified Development
Code, and all applicable local, state, and federal regulations, rulings or requirements.
2) Proposal shall comply with all requirements deemed necessary by the Grant County
Health District, by the Washington State Department of Health, and the Washington
State Department of Ecology regarding domestic water supply, sewage systems and
storm water control and treatment including, but not limited to; RCW 90.48.080
Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards;
WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site
Sewage Systems.
3) If any Native American Grave site(s) or archaeological/cultural resources (Indian
Artifacts) are found all construction activity shall stop and the owner/developer shall
immediately notify the Grant County Planning Department, the Colville Confederated
Tribes and the Washington State Office of Archaeology and Historic Preservation.
4) During road grading and/or constriction activities, county roads shall be maintained
clear of soil and rocks at the point of ingress / egress.
S) This proposal shall comply with the requirements of GCC 23.12.080 Clearing,
Grading and Drainage Standards, including but not limited to:
a) Clearing and grading activities shall be conducted so as to minimize potential
adverse effects on offsite property.

e) A note shall be placed on the face of the plat establishing a 40' critical areas
buffer on the north side of lots 29 thru 37. The southern edge of the buffer
shall be staked and the note shall include wording restricting all development
within the buffer.
f) All references to Short Plat shall be corrected to reference Long Plat.
g) Page numbers shall be corrected.
h) Identify names of adjacent subdivisions on the face of the plat.
i) Correct and add the following "block" of information to the final plat.
