HomeMy WebLinkAboutResolution 01-094-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION NUMBER 2001 -94 -CC A RESOLUTION authorizing an appropriation and expenditure of funds for the following department/fund: ('„rrpnr KxpengP Fund #001 Sheriff's Department #114 together with a budget therefore, pursuant to RCW 36.40.140. WHEREAS, it has been brought to the attention of the Board of County Commissioners of Grant County that emergency conditions require that an appropriation and expenditure of funds be authorized for the above- mentioned department/fund, together with a budget therefor; and WHEREAS, pursuant to RCW 36.40.140, Resolution No. ?ooi-so-cc Was duly adopted on May 29, 2001 , and published in the _ Daily Herald on 6/8&15/01 declaring an emergency and stating the facts constituting the emergency and the estimated amount of funds required to meet it, together with a notice of public hearing, and said public hearing was held thereon where interested persons were allowed to appear and be heard: NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, STATE OF WASHINGTON, that an appropriation and expenditure of funds is hereby authorized for the following department/fund: Current Expense Fund #001 Sheriff's Dept.#114 In the total sum of $ 9,629 according to the attached budget. This resolution is in the best interests of good government and shall take effect immediately upon its passage. In this contract, the Sheriffs Office will provide one reserve deputy to assist in law enforcement protection at Sun Lakes State Parks. The amounts are listed on the attached page, therefore we are asking for a $9,628.06 budget extension in wages and benefits to cover our expenses. State 74a&wW a Grant County Commissioners MAY 16M WASHINGTON STATE PARKS AND RECREATION COMMISSION GRANT COUNTY SHERIFFS OFFICE SUN LAKES -DRY FALLS STATE PARK COOPERATIVE AGREEMENT THIS AGREEMENT is made and entered into by and between the GRANT COUNTY SHERIFFS OFFICE, a Law Enforcement Agency with jurisdiction in Grant County, Washington, hereinafter referred to as the "L.E. Agency", and the STATE OF WASHINGTON, PARKS AND RECREATION COMMISSION, hereinafter called "Parks," under the authority of Chapter 39.34 RCW, entitled Interlocal Cooperation Act, and Chapter 79A.05 RCW. WHEREAS, Parks owns land near Coulee City in Grant County, Washington, known as Sun Lakes -Dry Falls State Park, which is maintained and operated by Parks for recreational use by the public; and, WHEREAS, Parks has requested that the L.E. Agency provide personnel to assist Parks in enforcement duties in order to keep Sun Lakes -Dry Falls State Park in an orderly condition for the public's use, education, safety and enjoyment; and, WHEREAS, the L.E. Agency wishes to provide personnel to assist Parks with said enforcement duties under certain terms and conditions as specified herein NOW, THEREFORE, Parks and the L.E. Agency do hereby mutually agree as follows: The L.E. Agency shall assign a commissioned law enforcement officer to assist Parks with law enforcement duties as agreed by the parties hereto. Such assistance shall be provided under the supervision of the Park Manager of Sun Lakes -Dry Falls State Park, in all areas of the site owned by Parks known as the Sun Lakes -Dry Falls State Park Area- 2. rea 2. The term of this Agreement shall commence on the date last signed by the parties hereto and shall expire on September 10, 2001 (or earlier at such time as the total funds provided by Parks for this Agreement have been expended as outlined in item 43 below). 3. In consideration for the services provided by the L.E. Agency personnel to Parks, Parks will pay to the L.E. Agency an hourly wage at the rate of $13.78 /hr., up to a maximum amount of $9628.06 for the entire agreement. Payment and associated support documentation will be accomplished in a manner as agreed by the Manager of Sun Lakes -Dry Falls State Park and the L.E. Agency. 4. Parks and the L.E. Agency shall each appoint representatives who shall be responsible for communications between the parties. Unless otherwise designated in writing, Parks' contact will be the Manager of Sun Lakes -Dry Falls State Park Area, Harry Malloy, and the L.E. Agency contact will be with Chief Deputy Dave Ponozzo. The L.E. Agency shall provide all uniforms and enforcement equipment for their employee as agreed upon by Parks and L.E. Agency. The L.E. Agency employee shall keep his/her uniform neat and professional, and present themselves in a professional manner. 6. Sun Lakes -Dry Falls State Park will provide a Law Enforcement Vehicle equipped with overhead lights, siren, loud speaker, and radio, as outlined in the applicable Parks' Law Enforcement Directives. 7. Parks and the L.E. Agency each agree to be responsible and assume liability for their own wrongful and/or negligent acts or omissions, or those of their officers, agents or employees to the fullest extent required by law. In the case of negligence of more than one party, any damages allowed shall be levied in proportion to the percentage of negligence attributable to each party. 8: This agreement may be modified or amended at any time upon the mutual written consent of the parties. A copy of any such written consent shall be appended to this agreement and by reference incorporated herein. The parties agree that the waiver or failure to enforce any provision of this Agreement by either party shall not in any way waive the other provisions of this Agreement, or right to enforce the Agreement. 10. This agreement shall terminate at the end of the original or any renewed term specified herein; at any time upon the mutual written agreement of the parties: or, upon thirty (30) days advance written notice by either party to the other for any reason 11. This agreement, and any written attachments or amendments thereto, constitute the complete contractual expression of the parties and any oral representations or understandings not incorporated herein are excluded.
