REASONABLE USE EXCEPTION FOR TWO PARCELS EQUALING } 3.88 ACRES COMBINED. SUBJECT } RESOLUTION NO. 2ooi-197-cc SITE LOCATED IN SECTION 2, } TOWNSHIP 21 N, RANGE 23 E. WM } David Neissinger WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on November 7, 2001, on the matter of approving a Reasonable Use Exception, in the Rural Residential -1 zone, for two parcels totaling 3.88 acres when combined, located in a portion of Section 2. Township 21 North, Range 26 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant County Planning Commission on November 7, 2001 made a recommendation to the Board of County Commissioners to approve this proposed plat alteration with the (6) six suggested Conditions of Approval and (4) four Findings of Fact as prepared by the planning staff; and WHEREAS, the Grant County Board of Commissioners held a closed record public meeting on December 3, 2001 in the Commissioners Hearing Room of the Courthouse; and WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the Reasonable Use Exception; and WHEREAS, the Board of Countv Commissioners have concluded that the Reasonable Use Exception conforms to the general purpose of the Comprehensive Plan, the Grant County Unified Development Code, and WHEREAS, the Board of Countv Commissioners have found that appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites and grounds and other public and private facilities and improvements have been made; and WHEREAS, the Board of County Commissioners have found that the Reasonable Use Exception conforms to the Criteria of Approval identified in Section 23.04.170 of the Grant County Unified Development Code; and WHEREAS, the Board of County Commissioners have made a decision to uphold the Planning Commission's recommendation to approve the proposed Reasonable Use Exception request. File # 01-3? 17 1 Page 2 of 3 David Neissinger Reasonable Use Exception_ — _ Resolution # NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington hereby approve the David Neissing Reasonable Use Exception for two parcels totaling 3.88 acres when combined, subject to the following six (6) Conditions of Approval and four (4) Findings of Fact as recommended by the Planning Commission CONDITIONS OF APPROVAL: The following are conditions of approval, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the proposed Reasonable Use Exception: Development shall be in compliance with the Washington State Environment Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 3. Development shall comply with all conditions imposed by the Grant County Public Works Department, including but not limited to acquiring an access permit from the Washington State Department (if Transportation. 4. Developer shall comply with all requirements of the Washington State Department of Transportation 5. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 6. Reasonable Use Exception approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of September 26, 2001. FINDINGS OF FACT: The following are (4) four Findings of Fact, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the proposed Reasonable Use Exception: I) The Grant County Board of County Commissioners have concluded that appropriate provisions for drainage. roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds. fire protection facilities, school David Neissinger Ping. File # (11-32 17 7 Page 3 of 3 David Neissing Reasonable Use Exception _ _ Resolution # sites, and grounds and other public and private facilities and improvements have been made. 2) The Grant County Board of County Commissioners have concluded that the Reasonable Use Exception conforms to the General Purpose of the Comprehensive Plan, the Grant County Unified Development Code, and SEPA. 3) The Grant County Board of County Commissioners have concluded that the public use and interest will be served by the proposal. 4) The Grant County Board of County Commissioners have concluded that the proposed Reasonable Use Exception conforms to the Criteria for Approval identified in Section 23.04.170 of the Grant County Unified Development Code.
