IN THE MATTER of establishing a

2001-1 in the North 'h of Section 33, Resolution of Intent
Township 21 North, Range 26 East
W. M.
A Resolution of the Board of County Commissioners of Grant County, Washington, declaring the
intention of the Board of County Commissioners to improve the roads and streets within the North
1/2 of Section 33, Township 21 North, Range 26 East W M., and more particularly described as
follows:

by acquiring rights of way, by constructing or reconstructing, grading, shaping, installing drainage
structures, furnishing and placing crushed surfacing, constricting approaches, paving with bituminous
surface treatment, installing traffic control devices, and by doing all work necessary in connection
therewith, and setting forth the nature and territorial extent of the improvement, stating the estimated
cost thereof and the proportionate amount to be borne by the property within the proposed district,
fixing a time and date for a hearing thereon and directing the County Road Engineer to prepare a
Preliminary Assessment Roll.
WHEREAS, the County Engineer recommends that the property in the proposed district is
sufficiently developed, and
WHEREAS, a petition has been tiled requesting the improvement of roads and streets within the
North 1/2 of Section 33, Township 21 North, Range 26 East W.M., and
WHEREAS, the County Auditor reports that the petition has been signed by the owners of property
to an aggregate amount of a majority of the lineal frontage upon the improvement to be made and to
an aggregate amount of a majority of the area within the limits of the proposed assessment district.
THEREFORE BE IT RESOLVED, By the Board of County Commissioners of Grant County,
Washington as follows:

Section 1. The Board of County Commissioners of Grant County, Washington, finds that the petition
submitted for the requested Road Improvement is sufficient and the property within the proposed
District is sufficiently developed, and that it is the intention of the Board of County Commissioners
to establish a Road Improvement District for the purpose of improving the following roads and streets
within the North 1/2 of Section 33, Township 21 North, Range 26 East W.M.:

Section 2. The territorial extent of the proposed improvement is described as follows:
That portion of the North 'V2 Section 33. Township 21 North, Range 26 East W.M., Grant County,
Washington, described as follows:
Beginning at the Northeast corner of said Section 33: thence S 0035'50"E, following the east boundary of said
Section 33 and the centerline of Dodson Rd, 429.00 feet to the True Point of Beginning; thence S88020'35"W
following the projection of the north boundaries of Tracts 5, 8. 17, 20 & A according to the Akerblade Record
of Survey, recorded in Book 1, Page 5 I, records of Grant County. Washington, and a portion of the Northwest
quarter of the Northwest quarter of said Section 33, referred to as Tract A, 2,644.10 feet to an intersection with
the west boundary of said Northwest quarter: thence SO 1046"E. following said west boundary 452.09 feet to
an intersection with the north right-of-way line of" Country Rd 12.9 -NW'; thence S88020'55"W, following
said right-of-way boundary. 419.40 feet: thence SOO' 35'50"E, following the projection of the west boundaries
of Tracts 29, 30 & 31, 1,831.67 feet to the southwest corner of Tract 31, according to said Akerblade Record
Survey and to an intersection with the south boundarN of said North half of said Section 33; thence
N88°33'19"E, following said south boundary, 441.21 fttir to the Ccntcr of said Section 33; thence continue
N88031'30"E, following said south boundar}, 1,546.69 feet to the southeast corner of Tract 13 of said
Akerblade Record Survey; thence N00°35'50"W, following the east boundaries of Tracts 13, 14 & 15 of said
Akerblade Record Survey, 1326.02 feet, thence N88°20'55"E, following the projection ofthe south boundaries
of Tracts 9 & 4 of said Akerblade Record Swvc�, 1,079 99 feet to an intersection with the centerline of
Dodson Rd. and the east boundary of said Section 33. thence N00' 35'50"W. following said centerline and said
section line 963.99 feet to the True Point of Beginning and there ternunating.
Section 3. The estimated cost and expense of the proposed improvement is hereby declared to be
approximately as follows:

For properties in the District 100% of the total cost of required improvements shall be assessed to
the properties.
The Board of County Commissioners shall consider the establishment of assessment reimbursement
accounts and the terms of reimbursement required of underdeveloped properties on whose behalf
payments of assessments have been made.
Section 4. It is the intention of the Board of County Commissioners to establish a road improvement
district to be known and designated as Grant County Road Improvement District No. 2001-1, which
district includes properties fronting or abutting upon the roads to be improved.
Section 5. All persons who may desire to object to the construction of the aforementioned
improvement orthe formation ofthe aforesaid improvement district are hereby notified to appear and
protest such objections at a meeting of the Board of County Commissioners to be held on:
Tuesday, October 2, 2001 at 7:00 p.m.
in the County Commissioner's Hearing Room in the Grant County Couthouse Annex, 35 C Street
N.W., Ephrata, WA., at which time and place is hereby fixed for hearing and matters relating to the
proposed improvement and all objections thereto and for determining the method of payment of said
improvement.
Section 6 The County Engineer hereby is directed to submit to the Board of County Commissioners
at or prior to the date fixed for such hearing an assessment map or print showing thereon the lots,
tracts and parcels of land and other property which will be specially benefitted thereby together with
a preliminary assessment roll showing the estimated amount of the cost and expense of such
improvement to be borne by each lot, tract or parcel of land or other property, and also designating
thereon all property which is being purchased under contract from the County, if any. The nature of
improvement contemplated for said district is such that the special benefits conferred on the property
of the district are fairly reflected by the use of an area assessment method and that for the purposes
of said district the assessments shall be made against the property of the district in accordance with
the special benefits it will derive from the improvement by use of the area assessment method.

Section 7. The Clerk of the Board of County Commissioners is hereby directed to give notice of said
hearing by publication of this Resolution in at least two consecutive issues of a newspaper of general
circulation in Grant County, the date of the first publication to be at least 15 days prior to the date
fixed for hearing by this Resolution before the Board of County Commissioners.
Notice of the adoption of this Resolution of Intention and Notice of Hearing thereon shall be given
by each owner or reputed owner of any lot, tract or parcel of land or other property within the
proposed improvement district by mailing said notice to the owners or reputed owners ofthe property
as shown on the tax rolls of the County Treasurer at the address shown thereon at least 15 days before
the date fixed for the public hearing. The said notice shall set forth the nature of the proposed
improvement, the total estimated cost, the proportion of the total to be borne by the particular lot,
tract or parcel, the date and place of the hearing before the Board of County Commissioners and the
fact that property owners may withdraw their names from the petition or add their names thereto at
any time prior to 5:00 p.m. of the day before the hearing
The notice given to the public or to the owners of specific lots, tracts, or parcels of land relating to
the formation of a County Road Improvement District shall contain a statement that actual
assessments may vary from assessment estimates so long as they do not exceed a figure equal to the
increased true and fair value the improvement adds to the property
