HomeMy WebLinkAboutResolution 01-159-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF APPLICATION FOR A RESOLUTION NO. 2001 -159 -CC REASONABLE USE EXCEPTION SUBJECT SITE IS LOCATED IN A PORTION RESOLUTION APPROVING OF SECTION 20, TOWNSHIP 24 NORTH, REASONABLE USE RANGE 27 E.W.M., GRANT COUNTY, EXCEPTION WASHINGTON. JOHN AND PATRICIA H EFFNER WHEREAS, the Board of Countv Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on October 1, 2001, on the matter of granting a reasonable use exception to John and Patricia Heffner to allow the development of a one (l ) acre parcel in the Shoreline Development 3 (SD3) Zone of Grant County. The subject parcel (416- 2152-014) is located in a portion of Section 20, Township 24 North, and Range 27 East Willamette Meridian, Grant County, Washington and; WHEREAS, the Grant County Planning Commission on September 5, 2001 made a recommendation to the Board of County Commissioners to approve this proposed Reasonable Use Exception and; WHEREAS, the Grant County Board of Commissioners held a closed record public meeting on October 1, 2001 and; WHEREAS, the Board of Countv Commissioners have made a decision to uphold the recommendation to approve the proposed Reasonable Use Exception and; WHEREAS, the Board of Countv Commissioners have found that the proposal is consistent with the Grant Countv Comprehensive Plan and; WHEREAS, the Board of Countv Commissioners have found that the public use and interest will apparently be served by the Reasonable Use Exception and; WHEREAS, the Board of Countv Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal and; Page 1 of 3 IN THE MATTER OF GRANTING REASONABLE John and Patricia USE EXCEPTION TO: Heffner NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, that a Reasonable Use Exception be granted to John and Patricia Heffner to allow the development of a one (1) acre parcel, in the Shoreline Development 3 (SD3) zone which is located in aportion of Section 20, Township 24 North, Range 27 East, Willamette Meridian, Grant County, Washington. CONDITIONS: The following are conditions of approval, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the granting of Reasonable Use Exception. 1) The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Unified Development Code and all applicable federal, state, and local regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District 3) Proposal shall comply with all requirements deemed necessary by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RC W 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 4) Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines (New construction will require water supply documentation to meet code), the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection/life safety. Page 2 of 3 IN THE MATTER OF GRANTING A REASONABLE John and Patricia USE EXCEPTION ON A ONE (1) ACRE PARCEL IN THE Heffner SHORELINE DEVELOPMENT 3 (SD3) ZONF. 5) Proposal shall comply with all requirements of the Grant County Public Works Department, Including but not limited to the following: a) Access permits must be acquired. Width and spacing must conform to current County Standards, i.e., 30' maximum width. and 50' minimum between nearest edge of approaches. 6) Proposal shall comply with all requirements of the Grant County Auditor. 7) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department,Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 8) Approval of the Reasonable Use Exception shall be contingent upon conformance with all applicable land use rules and regulations in effect as of August 17, 2001. 9) Proposal shall comply with all requirements of the United States Department of the Interior, Bureau of Reclamation. 10) Proposal shall comply with all requirements of the Grant County Assessor's Office. �1 Done this _ _ day of (;, ('?� 2001.
