HomeMy WebLinkAboutResolution 01-164-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington A RESOLUTION RESETTING THE MINIMUM BID FOR THE SALE OF GRANT COUNTY PROPERTY LOCATED IN EPHRATA, WASHINGTON, AND CALLING FOR A PUBLIC AUCTION RESOLUTION NO. 01- 164 -CC A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON: SETTING A MINIMUM BID FOR THE SALE OF SURPLUS BUILDINGS; REQUESTING THAT THE GRANT COUNTY TREASURER HOLD A PUBLIC AUCTION REGARDING SAME; AND, PROVIDING FOR OTHER MATTERS PROPERLY RELATING THERETO. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY, WASHINGTON, as follows: WHEREAS, Grant County, Washington (the "County"), is a Class 3 County, duly organized and existing under the Constitution and the laws of the State of Washington; and WHEREAS, the Board of County Commissioners (the `BOCC") is authorized to conduct proceedings and to sell surplus property when it appears that it is for the best interests of the County and the people thereof that the Grant County property should be sold, pursuant to the limitations and restrictions and in the manner provided in chapter 36.34 RCW; and WHEREAS, the County previously declared the fixtures and improvements on the County's real property located at 44015[ Street NW, Ephrata, Grant County, Washington, Grant County Parcel No. 14 0964 000, as surplus property, in Grant Countv Resolution No. 01 -119 -CC; and A RESOLUTION APPROVING THE SALE OF COUNTY PROPERTY LOCATED IN EPHRATA, WASHINGTON, AND CALLING FOR A PUBLIC AUCTION Page 1 H \FORMS\CIVIL8M-R\RESOLUTIONS\PERSONAL PROPERTY 1001 DOC WHEREAS, the County Treasurer lawfully advertised and conducted a surplus property sale regarding the aforementioned property, the Board of County Commissioners (BOCC) having previously set a minimum bid of Fifteen Thousand and No/ 100 Dollars ($15,000.00); and WHEREAS, the County did not receive any bids; WHEREAS, the fixtures and improvements on said property, i.e., house and garage, do not permit the highest and best use of the property by the County; and WHEREAS, the County will be required to expend public funds to remove the fixtures and improvements currently existing on said property prior to preparing the real property for a use compatible with existing County needs; and WHEREAS, the subject property, i.e., fixtures and improvements, is not in current use by the County, and is not needed by the County; and WHEREAS, it appears that it is for the best interests of the County and the people thereof that the subject County property should be sold; and WHEREAS, the BOCC has requested that the County Treasurer conduct another surplus property sale, and determined the minimum bids to be Two Thousand, Five Hundred and No/ 100 ($2,500.00) for the house and Two Hundred, Fifty and No/] 00 ($250.00) for the garage. NOW, THEREFORE, BE IT RESOLVED, as follows: Section 1: The BOCC has found and determined that it appears that it is for the best interests of Grant County and the people thereof that the County property as set forth herein, i.e., house and garage, should be sold as a unit. Section 2: The BOCC intends to offer the subject property for sale for the minimum bid of Two Thousand, Five Hundred and No/100Dollars ($2,500.00) for the house and, Two Hundred, Fifty and No/100 ($250.00) for the garage, upon such terms and conditions as to the BOCC may seem right in the premises. Section 3: The Grant County Treasurer is hereby directed to hold and supervise a public auction on the proposition as set forth herein, in accordance with law. A RESOLUTION APPROVING THE SALE OF COUNTY PROPERTY LOCATED IN EPHRATA, WASHINGTON, AND CALLING FOR A PUBLIC AUCTION Page 2 H \FORMS\CIVILR\M-R\RESOLUTIONS\PERSONAL PROPERTY 1001 DOC Section 4: All actions heretofore taken in connection with the proposal to dispose of the subject County property by the BOCC, employees and/or agents of the County that are not inconsistent with the provisions of this Resolution are hereby ratified, confirmed and approved. Section 5: All resolutions or parts thereof in conflict herewith are hereby repealed to the extent of said conflict, including without limitation, Grant County Resolution No. 01-119-C C. This Resolution shall be in effect from and after its date of adoption. Section 6: County staff shall prepare the necessary papers for the sale of the subject County property upon such terms and conditions as the BOCC deems just and right in the premises as set forth herein, in accordance with law.
