AMENDMENT TO THE UNIFIED
DEVELOPMENT CODE REGARDING
MINOR WATERSKI LAKES AS SMALL
SCALE RECREATION AND TOURISM

RESOLUTION DENYING A UNIFIED
DEVELOPMENT CODE AMENDMENT
WHEREAS, the Board of County Commissioners of Grant County have been
advised by the Grant County Planning Commission that a open record public hearing was
conducted on September 5, 2001 on the matter of amending the Grant County Unified
Development Code in regard to including Small Scale Water-ski Lakes as a use within Small
Scale Recreation and Tourism, and;
WHEREAS, the Grant County Planning Commission vote on September 5, 2001
did not establish a recommendation for or against this UDC Amendment request and therefore
the request was forwarded to the Board of County Commissioners without a recommendation,
and;
WHEREAS, the Board of County Commissioners of Grant County held an open
record public meeting on October 29, 2001, and;
WHEREAS, the Board of County Commissioners have been advised by the
Grant County Planning Department that the proposed UDC Amendment was processed in
accordance with the requirements of UDC Chapter 25.04 "Permit Application Review
Procedures"; and,
WHEREAS, the Board of County Commissioners have been advised by the
Grant County Planning Department that the proposed UDC Amendment was processed in
accordance with the requirements of UDC Chapter 24.04 "State Environmental Policy Act"; and,
WHEREAS, the Board of County Commissioners of Grant County have found
that a Determination of Significance and Adoption of Existing Environmental Documentation
was issued for this proposal on August 14,200 1, and
WHEREAS, the Board of County Commissioners have found that the proposal is
inconsistent with the Grant County Comprehensive flan; and,

WHEREAS, the Board of County Commissioners have found that the public use
and interest will not be served by this UDC Amendment; and,
WHEREAS, the Board of County Commissioners have found that the proposal
will adversely effect the health, safety, and general welfare of the public in the vicinity of the
proposal;
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners of Grant County do by this resolution deny amending the Grant County Unified
Development Code in regard to including Small Scale Water-ski Lakes as a use within Small
Scale Recreation and Tourism.
