Order Creating County Road
Improvement District 2001-1
A Resolution of the Board of County Commissioners of Grant County, Washington, declaring the intention of
the Board of County Commissioners to improve the roads and streets within the North 1/2 of Section 33,
Township 21 North, Range 26 East W.M.. and more particularly described as follows:

by acquiring rights of way. by constructing or reconstructing. grading, shaping, installing drainage structures,
furnishing and placing crushed surfacing. constricting approaches, paving with bituminous surface treatment,
installing traffic control devices. and by doing all other work necessary in connection therewith, and setting
forth the nature and territorial extent of the improvement. stating the estimated cost thereof and the
proportionate amount to be boric by the property within the proposed district, fixing a time and date for a
hearing thereon and directing the County Road Engineer to prepare a Preliminary Assessment Roll.
WHEREAS Resolution No 200 1 -146 -CC- passed and adopted on September 1 1.2001, declaring the intention
of the Board to order the improvement of roads and streets a ithm the North 1/2 of Section 33, Township 21
North, Range 26 East W.M., and fixing a time for the beau ing therein. and
WHEREAS said Resolution of Intention was duly published and the due notice of hearing was given as
required by law, and
WHEREAS the County Auditor has certified that the petition requesting formation of the road improvement
district has been signed by the owners of 54.54%, of the lineal frontage upon the improvement to be made, and
of 58.64% of the area within the limits of the proposed assessment district. and
WHEREAS a hearing was held as provided in said notice and after hearing and considering written and verbal
suggestions and recommendations of various property o\\ncrs \� ithin the district. the Board has ascertained that
the petition is sufficient, and has ascertained that the plan of improvements within the limits of the district is
feasible and has determined to order the constriction of said improvement.
THEREFORE BE IT RESOLVED. Bv_ the Board of Count\ Commissioners of Grant County, Washington
as follows:

Section 1. The Board of Count',: Commissioners of Grant Count, Washington, orders the improvements of
the following roads and streets within the North 1/2 of Section 33. Township 21 North. Range 26 East W.M.:

Section 2. It is hereby found and declared that the petition filed herein for the aforesaid improvement included
no additions thereto or withdrawals therefrom made prior to � 00 p in.. October 1. 2001. the day before the said
hearing.
Section 3. It is hereby ordered a modification to the original boundan of the proposed district be made as
follows: the northwesterly one-half of Tract A (see attached Exhibit 1) shall be removed from the proposed
district boundary. The new district boundan resulting f -om the modification is now supported by the legal
owners at 54.54% of the aggregate lineal frontage upon the improvements to be made and at 59.96% of the
aggregate area within the limits of the modified assessment district it is hereby declared that the petition, as
modified, is sufficient.
Section 4. It is hereby found and declared that the plan of constnuctron as herein outlined is feasible and the
benefits to be derived therefrom by the properh within the proposed district exceed the cost and expense of the
contemplated improvements
Section 5. There is herebv established a road improvement district in the County to be known and designated
as Grant County Road Improvement District No. 2001-1. which said district shall Include all the property
between the tennini of said improvements as described bclmN
The territorial extent of the proposed improvement is described as follows:
That portion of the North '/ Section 33. Township 21 North. Range 26 East W.M., Grant County,
Washington, described as follows:
Beginning at the Northeast corner of said Section 33. thence S 00")5'50"E, following the east boundary of said
Section 33 and the centerline of Dodson Rd. 429.00 feet to the TRIC Point of Beginning; thence S88°20'35"W
following the projection of the north boundaries of Tracts �. S. 17 & 20 according to the Akerblade Record
of Survey, recorded in Book ) , Page i 1 _ records of Grant Counts. Washington, a distance of 2,119.99 ft. to
the northwest corner of Tract 20 and the northeast corner of Tract A, thence S48020'39"W, 702.98 feet to an
intersection with the west boundary of said Northwest quarter and the north right-of-way line of"Country Rd.
12.9 -NW": thence S88°20'55"W. following said right -of -„a\ boundary. 419.40 feet, thence S00°35'50"E,
following the projection of the west boundaries of Tracts 21u. 30 & 31, 1,831.67 feet to the southwest corner
of Tract 31, according to said Akerblade Record Suu-vcv and to an intersection With the south boundary of said

projection of the south boundaries of Tracts 9 & 4 of said Akerblade Record Survey, 1,079.99 feet to an
intersection with the centerline of Dodson Rd. and the east boundar,, of said Section 33: thence N00°35'50"W,
following said centerline and said section line 963.99 feet to the True Point of Beginning and there terminating.
Section 6. It is deemed that the nature of the improvement contemplated for said district is such that the special
benefits conferred on the property of the district are fairly reflected b,, the use of an area assessment method,
and that for the purposes of said district the assessments shall be made against the property of the district in
accordance with the special benefits it will derive from the improvement by use of the area assessment method.
It is detennined that all assessments against the properties �\ithin the road improvement district will be paid
by the owners of the properties located within the North I /_ of Section 33- Township 21 North, Range 26 East
W. M.
Section 7. The County Engineer is hereby directed to establish a reimbursable project to provide moneys from
the County Road Fund for the payment of all costs and expenses of the constriction of said improvement and,
upon the determination of said costs and expenses, to prepauc and file with the Clerk of the Board of County
Conmtissioners an assessment roll for the costs of said nnpr-ov anent to be assessed against the property
included in the assessment district herein created. The Count\ Engineer is further directed to prepare plans and
specifications under which the proposed improvement will be constructed and either issue a Cali for Bids upon
the same, or utilize Grant County road crews to perform all or part of the necessary work.
Section 8. The Total Project Cost shall be the sum of the firllow ng items of estimated cost:

The total project cost shall be apportioned as follows
One hundred percent (100%) of the total project cost shall be borne by assessment against the
properties benefitted and included in the district hereinbefore created. Except as otherwise
provided herein, Grant Count,, shall not be liable in manner for any portion of the costs and
expenses of said improvement district.

Section 9. That there be and is hereby created in the office of the Grant County Treasurer two funds of the
County to be known and designated as "Grant County Road Improvement District No. 2001-1 Construction
Fund," and "Grant County Road Improvement District No 2001-t Bond Fund."
The Grant County Road Fund shall be reimbursed for all costs and expenses incurred by reason of the District
except those costs or portions of costs which Grant County agrees to bear as hereinbefore stated. Such
reimbursement shall be made by the issuance of warrants or other methods preferred by the Grant County
Treasurer against the Grant County Road improvement District No 2001-1 Construction Fund.
All moneys collected by the County Treasurer upon am assessments levied for the construction of said
improvement shall be placed in the said Construction Fund during the thirty (30) day period allowed for
payment of such assessment without penalty or interest and shall be placed in the said Bond fiord thereafter.
A bond for said improvement district. payable not later than ten ,ears from date of issuance, shall be sold to
the Grant County Road Fund or other source in the amount sufficient to reduce all outstanding warrants against
aforesaid constriction fiord for that portion of the cost and expenses of the installation of said improvement
to be assessed against the property within the district after determining the amount of such assessments paid
within the thirty (30) day period allowed for Payment of assessments Without penalty of interest.
The interest charged on the unpaid assessments shall be the same rate as the rate of interest the Road
Improvement District bond shall bear The bond interest ratc shall be the fair market rate as determined by the
Grant County Treasurer.
