RESOLUTION APRROVING
A PRELIMINARY PLAT FOR
HANSEN ESTATES
WILLAMETTE MERIDIAN. WASHINGTON. ) KEITH HANSEN, ETAL
WHEREAS, the Board of County Commissioners of Grant County have been advised by the
Grant County Planning Commission that an open record public hearing was conducted on October 2,
2002, on the matter to allow a three (3) phase, thirty (30) lot subdivision of approximately 34.71 acres
located in a portion of the Section 30, Township 19 North, Range 28 East, Willamette Meridian, Grant
County, Washington. Phase #1 shall consist of lots one (1) through ten (10) and Phase #2 shall consist
of lots of eleven (11) through seventeen (17) and lots twenty-six (26) through thirty (30). Phase #3
shall consist of lots eighteen (18) through twenty-five 1 25) Lots 19-22, located in Phase #3, are for
duplex homes only; and,
WHEREAS, the Grant County Planning Commission on October 2, 2002, conducted and open -
record public hearing and made a recommendation to the Board of County Commissioners to approve
the proposed preliminary plat with twelve (12) conditions of approval along with one (1) additional
condition of approval added at the public hearing due to City of Moses Lake comment; and,
WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on
Tuesday, October 29, 2002 at 11:00 am in the Commissioners Hearings Room of the Grant County
Courthouse in Ephrata, Washington; and,
WHEREAS, the Board of County Commissioners have made a decision to uphold the
recommendation from the Grant County Planning Commission to approve the proposed preliminary
plat request; and,
WHEREAS, the Board of County Commissioners have upheld the findings and conclusions of
the Grant County Planning Commission; and,
WHEREAS, the Hansen Estates Preliminary Platt Application has been processed in accordance
with Chapter 25.04 "Permit Application Review Procedures" of the Unified Development Code; and,

WHEREAS, the Board of County Commissioners. have found that the proposed subdivision is
consistent with the Grant County Unified Development Code; and,
WHEREAS, the Board of County Commissioners have found that the proposed subdivision is
consistent with the Grant County Comprehensive Plan: and.
WHEREAS, the Board of County Commissioners have found that the proposed subdivision
underwent SEPA review and a Mitigated Determination of Non -Significance (MDNS) was issued on
September 16, 2002; and,
WHEREAS, the Board of County Commissioners have found that the proposed subdivision
underwent Critical Areas review according to Grant County Code Chapter 24.08 and does not appear
to lie in any; and,
WHEREAS, the Board of County Commissioners have found that the proponent has made
appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary
wastes, parks, playgrounds, fire protection facilities, school sites, and grounds and other public and
private facilities and improvements; and,
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant
County, Washington, approve by this Resolution, the Preliminary long plat of Hansen Estates, a three
(3) phase, thirty (30) lot subdivision of approximately 14.71 acres with a total of thirty-four (34)
dwelling units. Phase #1 shall consist of lots one (1) through ten (10), Phase #2 shall consist of lots
eleven (11) through seventeen (17) and lots twenty-six (26) through (30). Phase #3 shall consist of lots
eighteen (18) through twenty-five (25). Lots range in size from .90± acres to 1.04± acres. Lots 19-22,
located in Phase #3, are for duplex homes only. The subject preliminary plat is located in a portion of
Section 30; Township 19 North; Range 28 East; Willamette Meridian, Grant County, Washington.
(Parcel Number: 17-0837-000).
CONDITIONS OF APPROVAL:
1) Development shall comply with all Conditions of Approval as listed in the Variance request
that was approved by the Board of Adjustment on January 9, 2002.
2) Development shall comply with the five (5) Conditions of Approval as listed in the Mitigated
Determination of Non -Significance issued on September 16, 2002.

3) The proponent shall comply with the Washington State Clean Air Act, including but not limited
to provisions of the Washington Administrative Code (WAC) 173-400-040(2) which states:
"No person shall cause or permit the emission of particulate matter from any source to be
deposited beyond the property under direct control of the owner(s) or operator(s) of the source
in sufficient quantity to interfere unreasonably with the use and enjoyment of the property upon
which the material is deposited." In addition, WAC 173-400-040(8) which states: "The owner
or operator of a source of fugitive dust shall take reasonable precautions to prevent fugitive
dust from becoming airborne and shall maintain and operate the source to minimize emissions."
4) Preliminary Plat approval shall be contingent upon conformance with all applicable land use
rules and regulations in effect as of September 18, 2002,
5) Development shall comply with GCC § 22.04.260; § 22.04.300; § 22.04.310; § 22.04.320;
§22.04.350; § 22.04.360; § 22.04.370; § 22.04 380: § 22.04.390; § 22.04.400; §22.04.410; and
§ 22.04.420.
6) Development shall comply with GCC § 23.04.030 and Chapter 23.04 Table 3.
7) Development shall comply with GCC § 23.12.030, § 23.12.040; § 23.12.050; § 23.12.060; §
23.12.070; § 23.12.080; § 23.12.100; § 23 12 1 10; § 23.12.120; § 23.12.130; § 23.12.150, §
23.12.160, § 23.12.170, and § 23.12.190.
8) Development shall comply with all requirements of the Grant County Health District including
but not limited to:
A) The location of each well and a zone of protection of 100 feet must be shown on the plat.
B) There must be a statement on the plat that no source of contamination will be allowed
within the designated 100 -foot radius shown for each lot. The zone of protection for the
wells on adjacent lots may overlap and may extend into the roads of the subdivision. It
may not extend outside the subdivision boundaries unless a restnetive covenant is
established with the owner of the adlacent property.
C) A site evaluation must be recorded with the Health District for each lot and the fee must
be paid. Contact the Health District rco� irding the number of test holes required.
9) Development must comply with all requirements of the Grant County Auditor's Office
including but not limited to:
A) On sheet #2 the title "building official' should be added to "fire marshal" under the
signature line.
B) In the dedication, the word "short' should he deleted in the third line.

10) Development must comply with all requirements of the Grant County Public Works
Department including but not limited to:
A) Provide a long plat fee of $100.00 plus $2.00 per lot for a total of $160.00.
B) All plat roads shall be built to Grant County road standards: 4" of crushed surfacing top
course with a 2 shot BST finish. Cul-de-sacs shall have a minimum finished width of
26' and the north -south through road a minimum finished width of 28'.
C) Provide all boundary lines, existing easements and dedications with Auditor File
Numbers and all proposed easements and dedications.
D) Provide all lots and blocks with numbers hearings and distances; same for plat
boundaries
E) Locate all features: permanent buildings, wells, watercourses, lakes,
overhead/underground utilities, boundaries. section lines and township lines.
F) Provide control monuments for all road intersections and centerline tangents.
G) Show adjacent subdivisions, if any, on the face of the plat.
H) Require a plat certificate from the title company if property is dedicated to the County.
I) Provide a complete road plan and profile with all centerline data and drainage facilities
for new roads.
J) Access permit must be obtained prior to Ii huilding permit.
11) Development must comply with all requirement,, of the US Bureau of Reclamation including
but not limited to:
A) Areas to the east and west of this location have seen a rise in the ground water table.
Rising groundwater tables are common In Irrigation projects. Although no formal
investigation of the subject area has been conducted by the Bureau of Reclamation, it
our recommendation that the developer he mindful of this issue. Federal drain
construction funds are not available for draining subdivisions and other areas not in a
commercial agriculture land use, unless such drainage is incidental to the required
drainage of adjacent agricultural land and meets Federal technical and economical
feasibility requirements.
B) The proposed development is located within the Quincy Ground Water Subarea and will
be subject to the laws and regulations related to the use of water within this area.
Therefore, should Mr. Hansen desire to use ground water for other than domestic
purposes (5,000 gallons per day/irrigation of 1/2 acre per dwelling, as established in
Chapter 90.44 RCW, WAC 173-134A), ne will be required to obtain both a Ground
Water Permit from the Washington State Department of Ecology and a Quincy Ground
Water Subarea license from Reclamation

C) On June 1, 1993, Reclamation initiated a moratorium on new license applications for
use of water from the Subarea. New water service is defined as any action that would
increase the amount of water used or acreage served. Reclamation's continuing
moratorium is required due to the Endangered Species Act (ESA) and National
Environmental Policy Act (NEPA) compliance requirements pertaining to the listing of
several species of Upper Columbia and Snake River system anadromous fish stocks as
threatened or endangered. Until interim and long-term water requirements have been
fully defined for anadromous fish runs listed under the ESA, Reclamation cannot
guarantee the availability of the Subarea water resources.
12) Development must comply with all requirements of the Grant County Department of
Emergency Services including but not limited to:
A) Proponents will need to contact this office to establish addressing and road names.
Roads will be named per the Count y ordinance.
13) The developer shall comply with GCC § 23.12.040 or work with the City of Moses Lake to
determine the wording of a "Covenant" to be recorded with the Grant County Auditor and
noted on the face of the plat, that will satisfy the City in regard to the required cash payment for
utilities pursuant to GCC § § 23.12.040 (g I
