IN THE MATTER OF APPROVING A
REASONABLE USE EXCEPTION PERMIT
FOR ONE PARCEL ON APPROXIMATELY
4.21 ACRES IN SIZE LOCATED IN THE
RURAL RESIDENTIAL 1 ZONE. THE SUBJECT
PARCEL IS LOCATED IN A PORTION OF LOT
#25, BLOCK #6 IN EPHRATA ORCHARD HOMES
PLAT IN A PORTION OF SECTION 21;
TOWNSHIP 21 NORTH; RANGE 26 EAST;
WILLAMETTE MERIDIAN, GRANT COUNTY,
WASHINGTON.

REASONABLE USE EXCEPTION

Whereas, the Board of County Commissioners of Grant County have been advised by the Grant
County Planning Commission that an open record public hearing was conducted on October 2, 2002, on the
matter of approving a Reasonable Use Exception to allow residential development of (1) one residence on (1)
one lot approximately 4.21 acres in size in the Rural Residential 1 Zone, located in a portion of Lot #25, Block
#6, in the Ephrata Orchard Homes Plat located in a portion of Section 2 t; Township 21 North; Range 26 East;
Willamette Meridian, Grant County, Washington; and,
Whereas, the Grant County Planning Commission on October 2, 2002, made a recommendation to
the Board of County Commissioners to approve this proposed Reasonable Use Exception with the (8) eight
suggested Conditions of Approval and (8) eight Findings of Fact as prepared by the planning staff; and,
Whereas, the Grant County Board of Commissioners held a closed record public hearing on October
22, 2002, in the Commissioners Hearing Room of the Courthouse; and,
Whereas, the Board of County Commissioners have found that the public use and interest will
apparently be served by the Reasonable Use Exception; and
Whereas, the Board of County Commissioners have found that appropriate provisions for drainage,
roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities,
school sites and grounds and other public and private facili(+es and improvements have been made; and,
Whereas, the Board of County Commissioners have concluded that the Reasonable Use Exception
conforms to the general purpose of the Comprehensive Plan. the Grant County Unified Development Code; and,
Whereas, the Board of County Commissioners have found that the Reasonable Use Exception
conforms to the Criteria of Approval identified in Section )'.04.170 of the Grant County Unified Development
Code; and,

Whereas, the Board of County Commissioners have made a decision to uphold the Planning
Commission's recommendation to approve the proposed Reasonable Use Exception request; and,
Now, therefore, be it resolved, that the Board of County Commissioners for Grant County,
Washington hereby approve the Granco Federal Credit Union Reasonable Use Exception Permit request on (1)
one parcel approximately 4.21 acres in size, for (1) one single family residence development capacity subject to
the following (8) eight Conditions of Approval and (8) eight Findings of Fact as recommended by the Planning
Commission.
AtConditions of Approval:'
The following are Conditions of Approval, which were used in the Grant County Board of County
Commissioner's closed record public meeting to approve the proposed Reasonable Use Exception:
1) Development shall be in compliance with the Growth Management Act, The County -Wide Planning
Policies, The Washington State Environment Policy Act, the Grant County Comprehensive Plan, the
Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings
or requirements.
2) Development shall comply with all applicable requirements of the Grant County Fire Marshall, the
Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code.
3) Developer shall comply with all requirements deemed necessary by the Grant County Health District,
the Washington State Department of Health, and the Washington State Department of Ecology regarding
domestic water supply, sewage systems and storm water control and treatment including, but not limited
to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards;
WAC 173-201A, Ground Water Quality Standards and WAC 246-272, On -Site Sewage Systems.
4) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all
construction activity shall stop and the owner/developer shall immediately notify the Grant County
Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology
and Historic Preservation.
5) Reasonable Use Exception approval shall be contingent upon conformance with all applicable land use
rules and regulations in effect as of September 13, 2002
6) Development shall comply with all requirements of the Grant County Public Works Department
including but not limited to:
A) An approach permit is required prior to the issuance of a building permit.
7) Development shall comply with all requirements of the Grant County Emergency Services Department
including but not limited to:
A) Address will need to be posted.

8) Development shall comply with all requirements of the Grant County Health District including but not
limited to:
A) Contact the Health District for information regarding well location and septic system
installation.
"Findings of Fact:"
The following are (8) eight Findings of Fact, which were used in the Grant County Board of County
Commissioner's closed record public hearing to approve the proposed Reasonable Use Exception:
1. Whether the application of this Chapter would deny all economically viable or beneficial uses of the
property, absent a demonstration by the county that the proposed use(s) are prohibited by the laws of
nuisance or other pre-existing limits on the property which prohibit such use(s);
2. Whether there are no other reasonable uses to which the property can be put;
3. Whether the proposed use or development poses an unreasonable threat to the harm sought to be avoided
by the application of this Chapter or the public health, safety or welfare on or off the site for which the
reasonable use exception is sought;
4. Whether the inability of the applicant to derive reasonable use of the property is the result of actions by
the applicant in subdividing the property or adjusting a boundary line thereby creating the undevelopable
condition after the effective date of this chapter;
5. Whether the use exception being sought is the minimum necessary to allow for reasonable uses of the
property;
6. Whether such use exception being sought is consistent with the general purposes of this chapter and
other chapters of the GCC and the public interest;
7. Whether the applicant has not requested and been denied a variance under the provisions of GCC §
25.08, unless the reasonable use exception being sought includes relief from standards for which a
variance cannot be granted;
S. The Board of County Commissioners may issue, as part of the findings in any decision made under this
Subsection, conditions of approval, including modifications to the size and placement of structures and
facilities to minimize nonconformity to the requirements of this chapter and other chapters of the GCC.
