HomeMy WebLinkAboutResolution 04-015-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington IN THE MATTER OF APPROVING THE RESOLUTION No. 04- 015—CL PRELIMINARY PLAT, AN EIGHT (8) LOT SUBDIVISION ON 40 ACRES IN THE Approving A Preliminary Plat For RURAL RESIDENTIAL 1 ZONE OF GRANT COUNTY, LOCATED IN A PORTION OF Walter And Maria Stephens SECTION 27; TOWNSHIP 22 NORTH; RANGE 27 EAST; WILLAMETTE MERIDIAN, WASHINGTON. WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on November 5, 2003, on the matter to allow a eight (8) lot subdivision of approximately 40 acres located in a portion of the Section 27, Township 22 North, Range 27 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant County Planning Commission on November 5, 2003, conducted and open -record public hearing and made a recommendation to the Board of County Commissioners to approve the proposed preliminary plat with twelve (12) conditions of approval; and WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on January 13 in the Commissioners Hearings Room of the Grant County Courthouse in Ephrata, Washington; and WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation from the Grant County Planning Commission to approve the proposed preliminary plat request; and WHEREAS, the Board of County Commissioners have upheld the findings and conclusions of the Grant County Planning Commission; and WHEREAS, the Stephens Estates (FU 42 B 70) Preliminary Plat Application has been processed in accordance with Chapter 25.04 "Permit Application Review Procedures" of the Unified Development Code; and WHEREAS, the Board of County Commissioners, have found that the proposed subdivision is consistent with the Grant County Unified Development Code; and Page 1 of 4 WHEREAS, the Board of County Commissioners have found that the proposed subdivision is consistent with the Grant County Comprehensive Plan; and WHEREAS, the Board of County Commissioners have found that the proposed subdivision underwent SEPA review and a Mitigated Determination of NOD -Significance (MDNS) was issued on October 14, 2003; and WHEREAS, the Board of County Commissioners have found that the proposed subdivision underwent Critical Areas review according to Grant County Code Chapter 24.08 and does not appear to lie in any; and WHEREAS, the Board of County Commissioners have found that the proponent has made appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites, and grounds and other public and private facilities and improvements; and NOW, THEREFORE, BE IT RESOLVED THAT the Board of County Commissioners for Grant County, Washington, approve by this Resolution, a Preliminary Long Plat, the Stephens Estates (FU 42 B 70) a eight (8) lot subdivision of approximately 40 acres; and The subject preliminary plat is located in a portion of Section 27; Township 22 North; Range 27 East; Willamette Meridian, Grant County, Washington. (Parcel Number: 20-0051-003) Conditions of Approval Development shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code_ and all applicable local, state, and federal regulations, rulings or requirements. Development shall comply with all applicable requirements of the Grant County Fire Marshall, the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. 3. Development shall comply with all conditions imposed by the Grant County Public Works Department including but no limited to: a. Provided a Plat Check fee of $100.00 plus 2.00 per lot for a total of $116.00. b. Provide a plat certificate for dedicated land. C. An access permit is required prior to the issuance of a building permit. d. The following need to be added: Grant County has no responsibility to construct, improve, maintain, or otherwise service any private roads contained within this subdivision. e. The following needs to be added to the Note on the bottom left corner of sheet 1 of 2. "To Grant County for the uses and purposes here in mentioned, except the private roads." Page 2 of 4 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology, regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: site evaluations for septic systems, approved water system by the Washington State Department of Health. RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards and WAC 246-272, On - Site Sewage Systems. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 6. Preliminary plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of September 25, 2003. Pursuant to GCC 23.12.0700) and 23.04.080(f) a 100' foot set back shall be identified along the southern property line of proposed lots 445, #6, #7 and #8. 8. Development shall comply with all requirements of Grant County's Planning Department, including but not limited to: a) Please change "Max permitted DU's" to "Max Potential DU's" 9. Pursuant to GCC 23.04.080(d), The Right to Farm Disclosure language shall be added to the face of the plat or recorded with the Grant County Auditor and noted on the face of the plat. 10. Development shall comply with all requirements of the Grant County Auditors Office including but not limited to: a. The name "Stephens Estates (FU 42 B 70)" is approved. 11. Development shall comply with the requirements of the Grant Count Emergency Services Office including but not limited to: a) Roads will need to be designated to the county grid system. 12.
