HomeMy WebLinkAboutResolution 04-038-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION IN THE MATTER OF RESOLUTION No. 04- 038 -CC APPROVING THE PRELIMINARY PLAT, A TWO PHASE, THIRTY LOT SUBDIVISION ON 33 ACRES IN THE URBAN RESIDENTIAL Resolution Approving 2 ZONE OF GRANT COUNTY, LOCATED IN A Preliminary Plat for A PORTION OF SECTION 34; TOWNSHIP 19 Earl Hubsmith NORTH; RANGE 28 EAST WILLAMETTE MERIDIAN, WASHINGTON WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on December 3, 2003, on the matter to allow a thirty (30) lot subdivision of approximately 33 acres located in a portion of the Section 21, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant County Planning Commission on December 3, 2003, conducted an open -record public hearing and made a recommendation to the Board of County Commissioners to approve the proposed preliminary plat with nine (9) conditions of approval by the Grant County Planning Commission; and WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on February 2, 2004 in the Commissioners Hearings Room of the Grant County Courthouse in Ephrata, Washington; and WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation from the Grant County Planning Commission to approve the proposed preliminary plat request; and WHEREAS, the Board of County Commissioners have upheld the findings and conclusions of the Grant County Planning Commission; and WHEREAS, the Rainier Meadows Major Preliminary Plat Application has been processed in accordance with Chapter 25.04 "Permit Application Review Procedures" of the Unified Development Code; and WHEREAS, the Board of County Commissioners, have found that the proposed subdivision is consistent with the Grant County Unified Development Code; and WHEREAS, the Board of County Commissioners have found that the proposed subdivision is consistent with the Grant County Comprehensive Plan; and Page 1 of 4 H 1Con�mrsmonerslOFklds\Resalunon-O�dmancelllubsmrth d<x WHEREAS, the Board of County Commissioners have found that the proposed subdivision underwent SEPA review and a Mitigated Determination of Non -Significance (MDNS) was issued on November 18 2003; and WHEREAS, the Board of County Commissioners have found that the proposed subdivision underwent Critical Areas review according to Grant County Code Chapter 24.08 and does not appear to lie in any; and WHEREAS, the Board of County Commissioners have found that the proponent has made appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites, and grounds and other public and private facilities and improvements. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington, approve by this Resolution, the Preliminary Long Plat the Albrandt Major Plat a thirty (30) lot subdivision of approximately 33 acres; and The subject preliminary plat is located in a portion of Section 34; Township 19 North; Range 28 East; Willamette Meridian, Grant County, Washington. Legal Description (Based on plat certificate order no. GS 67694-1 Security Title Guarantee, Moses Lake, WA Dated August 29, 2003) Lot 4, Hubsmith Short Plat, According to the plat thereof recorded in volume 13 of short plats, pages 65 thru 68, records of Grant County Washington. Conditions Of Approval: Development shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2. Development shall comply with all applicable requirements of the Grant County Fire Marshall, the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. Development shall comply with all conditions imposed by the Grant County Public Works Department including but no limited to: a. Provided a Plat Check fee of $100.00 plus 2.00 per lot for a total of $162.00. b. All 1pcal access roads shall be built to current Grant County Road Standards, whidh call for 4" of base course, 2" of top course and a 2 shot BST driving Page 2 of 4 H \Cummrssionm\OF�elds\Resoluuon-Ordinance\Habsmtlh Aoc surface with a width of 28'. Roadway plans shall be submitted to the County for approval by the County Road Engineer. C. On the vicinity map the name of the plat shall be changed to Rainier Meadows Major Plat (Not Hubsmith). d. A temporary cul-de-sac will need to be placed at the north end of the access roads between lots 1&17 with easements to accommodate the cul-de-sac. C. A Plat Certificate from the Title Company will be required for land dedicated to the County. Access permit must be obtained before building permits. g. Roadway system as laid out results effectively in a dead end system over 1000' long. The road access system should be laid out to provide looping or secondary access. 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology, regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: a completed site evaluations for each lot. The evaluation must be done by a certified septic system designer and or licensed engineer. Final approval of the plat will not be given until this is completed and submitted to the Health District. Site registration is $275 per lot. RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards and WAC 246-272, On -Site Sewage Systems. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 6. Preliminary Long Subdivision approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of October 10, 2003. Development shall comply with the requirements of the Grant Count Emergency Services Office including but not limited to: a) establishment of an address for development at this location. Developer shall complete a traffic study pursuant to GCC 23.12.100(c). The developer shall utilize and incorporate all necessary mitigations as required and deemed appropriate by the Grant County Engineer. Pursuant to GCC UDC Ch 23.12.040(e)(1)(C) The Applicant shall work with the City of Moses Lake to develop covenant language regarding the development of future street, curb, sidewalk, gutter, water and sewer infrastructure requirements in favor of the City of Moses Lake.
