IN THE MATTER OF APPROVING AN Resolution # 2002 -131 -CC
AMENDMENT TO THE UNIFIED
DEVELOPMENT CODE. TITLE 23,
ZONING, AND CHAPTER 23.12
DEVELOPMENT STANDARDS. THE
PROPOSED CHANGE INCLUDES
A PROPOSED CHANGE TO THE SIDE AND
REAR SETBACK REQUIREMENTS FOR
CERTAIN RESIDENTIAL ZONING DISTRICTS
IN RURAL LANDS OF GRANT COUNTY
WHEREAS, the Board of County Commissioners of Grant County have been advised
by the Grant County Planning Commission that a open record public hearing was conducted on August
4, 2002 on the matter of amending the Grant County Unified Development Code. Title 23, Zoning,
Chapter 23.12, Development Standards; and
WHEREAS, the Grant County Planning Commission on August 6, 2002 voted and cast
a tie vote, resulting in a favorable recommendation being forwarded by the Grant County Planning
Commission to the Board of County Commissioners to approNe Option 2, as forwarded by staff and;
WHEREAS, the Board of County Commissioners of Grant County held a open record
public meeting on this proposal, as provided by law; and;
WHEREAS, the Board of County Commissioners have been advised by the Grant
County Planning Department that the proposed UDC Amendment was processed in accordance with
the requirements of UDC Chapter 25.04 "Permit Application Review Procedures"; and,
WHEREAS, the Board of County Commissioners have been advised by the Grant
County Planning Department that the proposed UDC Amendment was processed in accordance with
the requirements of UDC Chapter 24.04 "State Environmental Policy Act"; and,
WHEREAS, the Board of County Commissioners of Grant County have found that a
Determination of Significance and Adoption of Existing Environmental Documentation was issued for
this proposal on July 15, 2002 and;
WHEREAS, the Board of County Commissioners conducted an open record public
hearing on September 9, 2002, and
WHEREAS, both Option 91 and Option 42 were considered and after testimony given
by the Grant County Building and Fire Marshal, Dave Nelson, it was recommended to go with Option
#1, changing the rear and side setbacks as set forth in Table 2 to five (5) feet — Density, Dimension and
Open Space Standards for Rural Lands, Special and overlay Districts and Resource Lands Zoning
Districts and Table #3 — Density. Dimension and Open Space Standards for Rural Activity Center
Zoning Districts and;
WHEREAS, the Board of County Commissioners have found that Option #1 is
consistent with the Grant County Comprehensive Plan and internally consistent with the rest of the
Unified Development Code; and;
WHEREAS, the Board of County Commissioners have found that the public use and
interest will be served by the UDC Amendment; and,
WHEREAS, the Board of County Commissioners have found that the proposal will not
adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
of Grant County do by this Resolution, approve amending the Grant County Unified Development
Code in regards to the attached proposal identified as Option 41 reducing side and rear yard setbacks
from ten (10) to five (5) feet in all Rural Lands, Special and Overlay Districts, Resource Land and
Rural Activity Centers
