HomeMy WebLinkAboutResolution 03-001-CCBOARD OF COUNTY COMMISSIONERS, GRANT COUNTY, WASHINGTON IN THE MATTER OF A PLAT ALTERATION OF LOTS 411 & 494 OF DESERT AIRE DIVISION 1, 1 IN A PORTION OF SECTION 22; TOWNSHIP 14 NORTH; RANGE 23 EAST; WILLAMETTE MERIDIAN, GRANT COUNTY, WASHINGTON (CREATING 1 LOT). RESOLUTION NO. 2003 -001 -CC RESOLUTION APPROVING A PLAT ALTERATION CLIFFORD & RUTH NASER WHEREAS, the Grant County Board of Commissioners have been advised by the Grant County Planning Commission that an open record public hearing was conducted on November 6, 2002, on the matter of creating one lot from lots 411 & 494 of Desert Aire Division 1, in a portion of Section 22 Township 14 North; Range 23 East; Willamette Meridian, Grant County, Washington; (Parcels: #02-1689-016 & 02-1689-008, located in the RVRI Zone) and, WHEREAS, the Grant County Planning Commission on November 6, 2002, made a recommendation to the Board of County Commissioners to approve this proposed plat alteration subject to the conditions of approval; and, WHEREAS, the Board of County Commissioners held a closed record public hearing on December 3, 2002; and, WHEREAS, the Board of County Commissioners has made a decision to uphold the recommendation to approve the proposed plat alteration request; and, WHEREAS, the Board of County Commissioners has found that the proposal is consistent with the Grant County Comprehensive Plan; and, WHEREAS, the Board of County Commissioners has found that the public use and interest will apparently be served by the plat alteration; and, WHEREAS, the Board of County Commissioners has found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution and subject to the following conditions of approval, a plat alteration to create one lot from Lots 411 & 494 of Desert Aire Division 1, in a portion of Section 22; Township 14 North; Range 23 East; Willamette Meridian; Grant County, Washington. CONDITIONS OF APPROVAL: Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2. Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: RC W 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards and WAC 246-272, On -Site Sewage Systems. 3. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4. Development shall comply with all applicable requirements of the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. Development shall comply with all improvements required by the Grant County Public Works Department including, but not limited to: 1) Provide a re -plat check fee of $100.00. 2) Label Desert Aire Place, as well as, show and label all right of ways and roads with dimensions. 3) Label Tract "O" as to what it is. 4) Show all existing easements. " 6. Proposal shall comply with all requirements of the Grant County Assessor's Office, including, but not limited to: 1) Needs a Replat # on plat. 7. Proposal shall comply with all requirements of the Grant County Auditor, including but no limited to: 1) The plat name shall be, "Desert Aire No.l Replat 415." 8. Approval of the plat alteration shall be contingent upon conformances with all applicable land use rules and regulations in effect at the time the application was deemed to be "technically complete", September 13, 2002. FINDINGS OF FACT: The following are findings of fact, which were used in the Board of County Commissioner's decision to approve the proposed Plat Alteration: 1) (Does) meet the applicable requirements of Chapter 22.04; 2) (Does) serve the public use and interest; 3) (Does) comply with the Comprehensive Plan, the Zoning Code and other land use regulations, and SEPA; 4) (Does) comply with health requirements for sewage disposal and potable water supply; 5) (Does) contain an accurate legal description of the lots being created, and the roads and easements therein; 6) (Does) comply with Grant County and, where applicable, State Department of Transportation regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; PASSED AND ADOPTED this . day of JdH 2oo3.
