RESOLUTION APPROVING THE RESOLUTION No. 2003- 035 CC
RIMROCK ESTATES PRELIMINARY PLAT
OF 38.8 ACRES INTO SEVENTEEN LOTS.
IN GOVERNMENT LOTS 4&5 OF SECTION
29, TOWNSHIP 24N, RANGE 27 F.
WILLAMETTE MERIDIAN.
WHEREAS, the Grant County Board of County Commissioners have been advised that
an open record public hearing was conducted, before the Grant County Planning Commission on
February 5, 2003, on the matter of a preliminary plat of 38.8 acres into seventeen lots; which is
located in a portion of Government Lots 4 & 5 of Section 29, Township 24 North, Range 27
East, Willamette Meridian, Grant County, Washington; and
WHEREAS, the Grant County Planning Commission on February 5, 2003, did approve a
motion to recommend to the Board of County Commissioners approval of this proposed
preliminary plat with fifteen suggested Conditions of Approval; and
WHEREAS, the Grant County Board of Commissioners held a closed record public
hearing on March 17, 2003; and
WHEREAS, the Board of County Commissioners, have reviewed the application file,
staff report and Planning Commission minutes; and
WHEREAS, the Board of County Commissioners have found that the proposal will not
adversely effect the health, safety, and general welfare of the public in the vicinity of the
proposal; and
WHEREAS, the Board of County Commissioners have found that the proposal is
consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter
23.04 "Zoning", other land use regulations, and SEPA; and
WHEREAS, the Board of County Commissioners have found that the public use and
interest will apparently be served by the preliminary plat; and
WHEREAS, the proposed preliminary plat meets the applicable requirements of Unified
Development Code, Chapter 22.04 "Land Division;" and
WHEREAS, the proposed preliminary plat does comply with the Health District's
requirements for sewage disposal and potable water supply; and
WHEREAS, the proposed preliminary plat does contain an accurate legal description of
the lots being created, and the roads and easements therein; and
WHEREAS, the proposed preliminary plat does comply with Grant County regulations
pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure
improvements; and
WHEREAS, the Board of County Commissioners has made a decision to uphold the
Planning Commission recommendation and approve this preliminary plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Board of County
Commissioners for Grant County, Washington approve by this Resolution, and subject to the
Conditions of Approval listed below, a preliminary plat of 38.8 acres into seventeen lots; which
is located in a portion of Government Lots 4 & 5 of Section 29, Township 24 North, Range 27
East, Willamette Meridian, Grant County, Washington.
CONDITIONS OF APPROVAL:
1) Development shall be in compliance with the Washington State Environmental Policy
Act, the Grant County Comprehensive Plan, the Grant County Unified Development
Code, and all applicable local, state, and federal regulations, rulings or requirements.
2) Development shall comply with all applicable requirements of the Grant County Building
Department and Fire Marshal; including, complying with Fire Flow guidelines or
providing minimum setbacks to property lines as directed.
3) Before final plat approval the developer shall apply for and receive approval of a
shoreline variance, on lots 12 through 16, to the Shoreline Master Program requirement
for 80 feet of shoreline frontage per lot, or the developer shall reconfigure the lots to
comply with the Shoreline Management Program requirements.
4) Before final plat approval the developer shall apply for and receive approval of a variance
from UDC Development Standards [UDC 23.12.070(e) Lot depth to width ratio] on lots
10 through 16, or the developer shall comply with UDC 23.12.070(e).
5) Development shall comply with all improvements required by the Grant County
Department of Public Works; including,
a) Completion of a Traffic Study and completion of any required mitigations as
directed by the Department of Public Works before final plat approval.
b) Receiving proper approvals before making road cuts across the county road.
C) All lots are subject to a public utility easement 5 feet in width on all interior lot
boundaries and 10 feet in width on all exterior lot boundaries.

6) Developer shall comply with all requirements deemed necessary by the Grant County
Health District; including,
a) That no building permits will be issued until a community septic system is
completed and sewer hookups are in place.
b) An agreement for maintenance of the community sewer/septic system will be
required before building permits can be issued.
C) There will be a 100 foot wellhead protection area around all wells.
7) Developer shall comply with all requirements deemed necessary by the Washington State
Department of Health, and the Washington State Department of Ecology regarding
domestic water supply, sewage systems and storm water control and treatment including,
but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-
201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards and
WAC 246-272, On -Site Sewage Systems.
8) If any Native American Grave site(s) or archaeological/cultural resources (Indian
Artifacts) are found all construction activity shall stop and the owner/developer shall
immediately notify the Grant County Planning Department, the Colville Confederated
Tribes and the Washington State Office of Archaeology and Historic Preservation.
9) During any construction activities, county roads shall be maintained clear of soil and
rocks at the point of ingress / egress.
10) There shall be a 50 foot wetland buffer permanently staked parallel to the shoreline and
identified on the plat in which no development, artificial landscaping, or cutting of native
vegetation, shall occur.
11) Proposal shall comply with all requirements of the Grant County Auditor.
12) Approval of the plat shall be contingent upon conformance with all applicable land use
rules and regulations in effect as of December 17, 2002.
13) Development shall comply with all requirements of the Grant County Planning
Department, including but not limited to:
a) All requirements of UDC Chapter 22.04, Article V, Subdivisions and Short
Subdivisions.
b) The location, width, and nature of "proposed utility easements" located along
property lines shall be identified as a "note" and not drawn. In those cases where
USBR and/or irrigation district easements exist along property lines, the utility
easements shall run parallel and abutting said easements.
C) Add the following "block" of information to the final plat:

The Developer shall establish covenants, including but not limited to:
a) Require lot owners to protect and utilize the natural vegetation in landscaping
schemes to help maintain the natural character on the area and reduce the future
demand for weed control.
b) Boat moorage shall be limited to temporary methods that will protect wetlands;
i.e. utilizing offshore buoys, etc.
C) There shall be no structures developed within the 50 foot shoreline buffer.
d) Requiring strict control of pets to reduce predation and harassment of wildlife.
Individual wells are prohibited on lots west of Moore Road.
