SUBJECT APPROVING A PRELIMINARY SITE IS LOCATED IN SECTION 22, PLAT OF TOWNSHIP 21 NORTH, RANGE 26, EAST, BERSCHAUER HEIGHTS WM GRANT COUNTY WA WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on April 2, 2003, on the matter of a preliminary plat of 24.69 acres into five lots; which is located in a portion of Sections 22, Township 21 North, Range 26 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant County Planning Commission on April 2 , 2 003 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat with twelve (12) suggested conditions of approval; and WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on May 5, 2003; and WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes; and WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and WHEREAS, the B oard o f County Commissioners have found that the public u se and interest will apparently be served by the preliminary plat; and WHEREAS, the proposed preliminary plat meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and WHEREAS, the proposed preliminary plat does comply with the Health District's requirements for sewage disposal and potable water supply; and WHEREAS, the proposed preliminary plat does contain an accurate legal description of the lots being created, and the roads and easements therein; and Page 1 of 4 11\Commsuoners\OPidds\RcsoW�wo-Oidmenu\po-sehniin doc WHEREAS, the proposed preliminary plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and WHEREAS, the Board of County Commissioners have made a decision to approve the Berschauer Heights preliminary plat. NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of twenty-four point six nine (24.69) acres into five lots; which are located in a portion of Sections 22, Township 21 North, Range 26 East, Willamette Meridian, Grant County, Washington; CONDITIONS OF APPROVAL: Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4. During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 5. This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a. Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b. All development shall ensure that soil erosion and sedimentation of drainage - ways will be controlled to prevent damage to adjoining properties. C. Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. Roads shall be approved by the Grant County Emergency Services Department and shall be established using the addressing and grid system delineated in GCC 10.36. b. The applicant bears the responsibility of private road improvements necessary to meet the County Private Road Standards. The County shall not be responsible for maintenance of private roads, including snow removal, nor shall such roads be accepted as County roads until such improvements as are necessary are made to bring them to current Grant County standards. 7. All lots are subject to a public utility easement 5 feet in width on all interior lot boundaries and 10 feet in width on all exterior lot boundaries. 8. Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of March 10, 2003. 9. This proposal shall comply with all the requirements of the Grant County Public Works Department, including but not limited to: a. Provide a Long Plat check fee of $100.00 plus $2.00 per lot for a total of $110.00. b. The private road shall have a paved approach from the existing edge of County road to the right of way line. C. The utility easement shall be shown or noted to exist outside of the private read easement. d. 30 feet shall be dedicated for future road purposes along the southern boundary (section line) of the plat. e. Private road shall be built to Fire Code. f A plat certificate is required for dedicated lands. g. All curve data shall be shown for the cul-de-sac. h. Provide USBR section data. i. Access permit is required prior to the issuance of a building permit. 10. This proposal shall comply with all the requirements of the WA State Department of Ecology, including but not limited to: a. The Growth Management Act (Section 63) required an applicant to submit evidence of an adequate water supply before a building permit can be issued for any building requiring potable water. b. It is unlawful to construct, test, or utilize a non-exempt well without a water right permit. A permit or preliminary drilling authorization is required prior to the construction of a well. 11. The proposal shall comply with the requirements of the Grant County Health District, including but not limited to: Page 3 of 4 12. a. These lots are within the water service area for the City of Ephrata. Individual wells will not be allowed for these lots unless the City of Ephrata gives written authorization. b. Assuming that water and sewer utilities are not available, a site registration will be required for lots 2, 3, 4, and 5. The applicant must comply with the requirements of the Health District for sewer and water and a site registration must be done by a certified septic system designer or licensed engineer and be submitted to the Health District before final approval of the plat will be given. Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a. Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b. The location, width, and nature of "proposed utility easements" located along property lines shall be identified as a "note" and not drawn; furthermore, those cases where USBR and/or irrigation easements exist along property lines, the utility easements shall run parallel and abutting said easements. C. Add the following "block" of information to the final plat.
