HomeMy WebLinkAboutResolution 03-130-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION APPROVING THE REVISED RESOLUTION No. 03- JM -CC PRELIMINARY PLAT OF PARKER SPRING ACRES DIVISION #6. SUBJECT SITE IS Arlo Leishman LOCATED IN SECTION 1, TOWNSHIP 19 NORTH, RANGE 28, EAST, WM. GRANT CO. WA WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on August 6, 2003, on the matter of a revised preliminary plat of twenty-nine acres into twenty-one lots; which is located in a portion of Sections 1 & 12, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant County Planning Commission on August 6, 2003 did unanimously approve a motion to recommend to the Board of County Commissioners to approve this revised preliminary plat with the twelve suggested conditions of approval; and WHEREAS, the Grant County Board of Commissioners held an opened record public hearing on September 23, 2003; and WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission recommendation; and WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary plat; and WHEREAS, the proposed preliminary plat meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and WHEREAS, the proposed preliminary plat does comply with the Health District's requirements for sewage disposal and potable water supply; and WHEREAS, the proposed preliminary plat does contain an accurate legal description of the lots being created, and the roads and easements therein; and Page 1 of 4 WHEREAS, the proposed preliminary plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and WHEREAS, the Board of County Commissioners have made a decision to approve the revised preliminary plat. NOW, THEREFORE, BE HEREBY IT RESOLVED, THAT the Board of County Commissioners for Grant County, Washington approve by this Resolution, and with the conditions of approval listed below, a revised preliminary plat of twenty-nine acres into twenty- one lots; which is located in a portion of Sections 1 & 12, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; Conditions of Approval 1. The Proposal shall be in compliance with, the Washington State Environmental Policy Act, the Grant County Unified Development Code and all applicable federal, state, and local regulations, rulings or requirements; 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, including: a. The water system must be approved by the Washington State Department of Health for the additional 21 connections; b. A site evaluation will be required for each lot. The evaluation must be done by a certified septic system designer or licensed engineer and submitted to the Health District. 3. Proposal shall comply with all requirements deemed necessary by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173- 201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 4. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection and life safety. Roads need to be designated to the Grant County grid system per the Grant County Addressing Ordinance 85-143 CC. Brent Road within the proposed plat needs to be renamed. Developer must contact Grant County Emergency Services Office. Page 2 of 4 6. Proposal shall comply with all requirements of the Grant County Public Works Department, including, but not limited to the following: a. All lots shall have internal plat road access; no direct access shall be permitted from Road 5 NE. b. Roads shall be designed and built to current County Road Specifications. Four - inches (4") of crushed surface base course, two -inches (2") of crushed surface top course with a two (2) shot BST surface. C. An access permit is required prior to the issuance of a building permit. d. Lot 1 does not appear to be practical with the amount of land taken up by canal easements and setback requirements. 7. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found on the proposed site all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. Proposal shall comply with all requirements of the Grant County Auditor including, changing the name to read "Parker Spring Acres Division 6 (FU 30 B 41)" 9. Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of July 2, 2003. 10. During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 11. Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a. All requirements of UDC Chapter 22.04, Article V, Subdivisions and Short Subdivisions. b. The location, width, and nature of "proposed utility easements" located along property lines shall be identified as a "note" and not drawn. C. Add the following "block" of information to the final plat: Zoning: Rural Community Overall acreage: 29 acres Number of Lots: 21 Max Residential Density: 1 DU per acre Max Potential Res. Lots: 21 Roads: 5.85 acres R/W dedicated 12. Proposal shall comply with all requirements of the United States Department of the Interior, Bureau of Reclamation and the East Columbia Basin Irrigation District, including: Page 3 of 4 a. This proposed plat is within the Columbia Basin Project approval by the East District and the U.S. Bureau of Reclamation will therefore be necessary pursuant to RCW 58.17.310. b. The USBR right-of-way map indicates that the easement for the EL20 lateral expands from 40' west of the centerline to 85' west of the centerline at a point 45' north of the section line common to Sections 1 and 12. This dimension needs to be verified and depicted on the final plat. C. The District requests that Plat Restriction note C be revised to read "utility and irrigation easements".
